# Telehealth Insurance in Georgia

Georgia’s physician board requires a Georgia-licensed practitioner, a patient history, an examination basis that meets the in-person standard, and emergency follow-up instructions for care delivered electronically. Licensed counselors, social workers, and marriage and family therapists have a separate rule requiring verbal and written client consent before telemental-health services. Neither rule sets a professional-liability limit, so confirm the policy’s insured clinicians, entity, services, and locations directly with the broker.[^1][^2]

## What Is Virtual Care And Telehealth?

Telehealth liability can cover claims arising from remote health care, such as a video visit or remote monitoring. If you provide care online, match the quote to your clinicians, services and patient locations; cyber and in-person risks need separate review. [Read the national Virtual care and telehealth guide](/coverage/virtual-care-telehealth).

## What to Watch for in Georgia

### Physician Electronic-Care Conditions

Rule 360-3-.07 covers physicians and provides routes involving a prior examination, a referral, or technology that permits an examination equal or superior to in-person care. It also requires diligent efforts for an in-person examination at least annually. Ask your broker to review the covered clinician and telehealth services against the actual route your practice uses.[^1]

### Emergency Contact And Follow-Up

A patient treated electronically must receive the treating Georgia clinician’s name, credentials, emergency contact information, and clear instructions for emergent follow-up. Keep these steps in your service workflow and ask whether the policy covers the clinicians and entity responsible for the telehealth encounter.[^1]

### Counselor Vendor Consent

Georgia-licensed counselors, social workers, and marriage and family therapists must obtain and document verbal and written consent for telemental health, including disclosure of third-party vendors such as recordkeeping or billing services. Ask whether your entity’s policy lists the clinicians and contracted service model you actually use.[^2]

## Who Regulates Insurance in Georgia

**Georgia Office of Commissioner of Insurance and Safety Fire.** Georgia’s elected Insurance and Safety Fire Commissioner licenses and regulates insurance companies and insurance professionals, investigates insurance fraud, and oversees consumer complaint services. The Office’s state license lookup covers agents, agencies, and companies.[^3][^4][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4% of total premium when Georgia is the home state Georgia charges 4% on the total premium written and received by a surplus-lines broker when Georgia is the insured’s home state. Current fee treatment is not described here because the Department’s latest fee bulletin could not be retrieved as readable text; ask your broker for the policy-declaration and tax breakdown. This record does not state a Georgia-specific guaranty-fund conclusion.[^6]

## Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. [Check the regulator’s license lookup](https://oci.georgia.gov/agents-agency-licensing) and confirm availability with a provider when requesting a quote.

## Questions to Ask Before You Buy in Georgia

1. Does our policy name the professional entity and each physician, PA, and APRN who provides or supervises Georgia telehealth?
2. Does the policy schedule cover the actual video, store-and-forward, and telemental-health services we offer?
3. How should we document emergency-contact and vendor responsibilities for Georgia patients?

## Virtual Care And Telehealth in Georgia: FAQ

### Do telehealth clinicians treating patients in Georgia need Georgia authorization?

Yes. Georgia’s physician board rule requires Georgia-licensed practitioners for the covered electronic treatment and consultation, subject to its stated exceptions and routes; the separate counseling rule applies to counselors, social workers, and marriage and family therapists licensed in Georgia.[^1][^2]

### What consent does Georgia require for telemental-health services?

Verbal and written consent. The distant-site counselor, social worker, or marriage and family therapist must inform the client that technology-assisted services will be used, document both consents, and disclose third-party vendors.[^2]
