An out-of-state professional using Florida’s telehealth registration route must register, stay within Florida scope rules, and maintain professional-liability coverage or financial responsibility that includes Florida patient services. Out-of-state registrants must maintain liability coverage or financial responsibility for Florida patient services at the amount prescribed by Florida law. The March 2026 application asks all registrants to report a malpractice carrier, limits, and whether claims in Florida are covered; the Department says medical-malpractice insurance itself is required only for MDs and DOs. Have the broker verify the appropriate financial-responsibility route for each profession and confirm the policy's Florida claim treatment.[^1][^2][^3]

### The Out-of-State Route Is Telehealth Only

A registrant may not open a Florida office or provide in-person care to Florida patients under this registration. An emergency or consultation with a Florida-licensed professional who retains ultimate diagnostic and care authority can qualify for an exception to registration. Ask whether the practice also has Florida-licensed clinicians and keep their operations distinct on the application and policy schedule.[^1][^2]

### Profession and Prescribing Limits Still Apply

Florida applies the in-person scope and prevailing standard of care to telehealth. It bars most Schedule II prescribing, except for psychiatric treatment, hospital inpatient treatment, hospice, or nursing-home residents. Florida distinguishes required medical-malpractice insurance for MDs and DOs from the professional-liability or financial-responsibility requirement for all out-of-state registrants.
