# Telehealth Insurance in Arkansas

Arkansas includes a patient's home as a telemedicine originating site and bars telemedicine group therapy for children age 18 or younger. For social workers, a professional relationship is generally required; an internet questionnaire or similar one-way intake alone does not create one.[^1][^2]

## What Is Virtual Care And Telehealth?

Telehealth liability can cover claims arising from remote health care, such as a video visit or remote monitoring. If you provide care online, match the quote to your clinicians, services and patient locations; cyber and in-person risks need separate review. [Read the national Virtual care and telehealth guide](/coverage/virtual-care-telehealth).

## What to Watch for in Arkansas

### A Patient’s Home Is an Originating Site

Arkansas includes the patient's home as a telemedicine originating site. If your practice delivers care to patients at home, record Arkansas patient locations and ask the broker how the policy identifies those services and insured clinicians; a patient's home remains the relevant service location even when the clinician is elsewhere.[^1]

### A Professional Relationship Is Required

For Arkansas social workers, a professional relationship generally must exist before telehealth; the rule excepts emergencies and generic information. An internet questionnaire, email, patient-generated history, text, fax, or combination of those alone does not establish that relationship. Ask which organization and social-work services the quote schedules, and confirm policy terms separately.[^2]

### Group Therapy for Minors Is Excluded

Arkansas permits telemedicine group meetings, including therapy, but bars telemedicine group therapy for a child age 18 or younger. For adults in Medicaid-funded group programs, the Act allows telemedicine only if CMS permits that format. Separate the participant ages and program funding in your service schedule and quote request.[^1]

## Who Regulates Insurance in Arkansas

**Arkansas Insurance Department.** The Arkansas Insurance Department licenses resident and nonresident producers and business entities, accepts insurance complaints, and provides links to company and producer license searches. It operates as a division of the Arkansas Department of Commerce.[^3][^4][^8][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4% when Arkansas is the insured's home state Arkansas's broker filing instructions set a 4% surplus-lines tax. Federal law assigns nonadmitted-insurance regulation and tax to the insured’s home state; for a multistate policy, ask your broker to show the home state and the premium allocation used for the Arkansas filing. Arkansas law requires the contract to disclose that the state's property-and-casualty guaranty protection does not apply.[^6][^7][^9]

## Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. [Check the regulator’s license lookup](https://insurance.arkansas.gov/industry-regulation/licensing/) and confirm availability with a provider when requesting a quote.

## Questions to Ask Before You Buy in Arkansas

1. Which Arkansas-based clinicians and episodic consultants are included, and which entity employs or contracts with each?
2. Do our social-work or behavioral-health services meet the board’s relationship and follow-up requirements?
3. Does the quote include every group-therapy format and patient age our practice serves?

## Virtual Care And Telehealth in Arkansas: FAQ

### Can an Arkansas provider conduct telemedicine group therapy with minors?

No. Arkansas bars telemedicine group therapy for children age 18 or younger. The statute separately conditions telemedicine group therapy for adults in Medicaid-funded programs on CMS allowing the format.[^1]

### Can a social worker establish an Arkansas professional relationship through an online questionnaire alone?

No. Arkansas's social-work rule says an internet questionnaire, email, patient-generated history, text, fax, or combination of those alone does not establish the required professional relationship; emergencies and generic information are excepted from that requirement.[^2]
