# Virginia Umbrella and Excess Liability Guide

For a motor vehicle owner’s policy effective on or after January 1, 2025, Code of Virginia § 46.2-472(B) requires limits of $50,000 for bodily injury or death of one person, $100,000 for two or more persons, and $25,000 for property of others. Policies effective on or after January 1, 2022, and before January 1, 2025, remain on the subsection A amounts of $30,000, $60,000, and $20,000. Section 8.01-38.1 separately provides that the total awarded for punitive damages shall not exceed $350,000. The jury is not told the limit, and the judge reduces a larger verdict to $350,000. Match the umbrella’s underlying auto limit to the subsection that applies to that policy’s effective date.[^1][^2]

## What Is Umbrella And Excess Liability?

Umbrella or excess insurance adds liability limits above the policies named in the quote after a covered claim exhausts their limits. ## Virginia Requirements

| Owner’s policy limits on or after January 1, 2025 | Section 46.2-472(B) requires, exclusive of interest and costs, $50,000 for bodily injury or death of one person, $100,000 for two or more persons, and $25,000 for property of others. Subsection A, for policies effective on or after January 1, 2022 but before January 1, 2025, uses $30,000, $60,000, and $20,000. These are owner’s-policy limits, not an umbrella minimum.[^1] |

## What to Watch for in Virginia

### The effective date of the auto policy picks the statutory floor

A policy that took effect on December 15, 2024 is still in subsection A: $30,000/$60,000 bodily injury and $20,000 property. A renewal effective on or after January 1, 2025 moves to subsection B: $50,000/$100,000 and $25,000. If the umbrella was bound against the older floor, the renewal can breach the excess form’s underlying-limit warranty even though the insured complied with the statute that applied at inception. Re-read the schedule at each auto renewal.[^1]

### Punitive damages are reduced to $350,000

Section 8.01-38.1 says the total amount awarded for punitive damages shall not exceed $350,000. The jury shall not be advised of the limitation. If the jury returns more, the judge reduces the award and enters judgment for $350,000. Ask whether the excess form covers punitive damages at all. The statute cuts the judgment. It does not add punitive coverage to a policy that excludes it.[^2]

### Both tiers insure a permitted user, not only the named insured

Subsections A and B each require the policy to insure the named person and any other person using the vehicle with the named insured’s permission, for liability from ownership, use, or operation in the Commonwealth, any other state, or Canada. An umbrella that schedules only the named insured can be narrower than the auto statute. Ask who counts as a permitted user on both forms.[^1]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 2.25% of premium plus up to 0.1% Bureau Special Fund assessment The NAIC's state chart lists a 2.25% of premium plus up to 0.1% Bureau Special Fund assessment charge for surplus-lines coverage for Virginia (the chart's state entries were reviewed in October 2025).
