# Utah Umbrella and Excess Liability Guide

The Utah Insurance Department’s property and casualty review standards cite Utah Code section 31A-22-304 for motor-vehicle liability minimums of $25,000, $65,000, and $15,000 on a split limit, or $80,000 on a single limit. The department’s auto comparison guide states the same bodily-injury pair, $25,000 per person and $65,000 per accident, and a property-damage minimum of $15,000 per accident. It also says the law requires personal injury protection of at least $3,000 per person, and that motorcycle policies do not include that no-fault coverage. An umbrella attaches above the liability limits, not above the $3,000 no-fault benefit. A policy written only to an older $50,000 per-accident bodily-injury figure does not meet the split limit the department now cites.[^1][^2]

Umbrella or excess insurance adds liability limits above the policies named in the quote after a covered claim exhausts their limits. ## What to Watch for in Utah

### A single-limit policy has to reach $80,000, not the $65,000 bodily-injury accident figure

The review standards list two ways to meet section 31A-22-304: the split limit of $25,000, $65,000, and $15,000, or a combined single limit of $80,000. A $65,000 combined limit matches only the bodily-injury accident number and leaves out the property-damage leg of the split. Read the declarations for which form was used before you set the umbrella’s underlying schedule.[^1]

### No-fault benefits are $3,000 per person, and motorcycles are outside that coverage

The comparison guide says personal injury protection pays medical expenses, loss of income, and essential services for people injured in the auto regardless of fault, including pedestrians the auto injures, with a minimum of $3,000 per person. It says motorcycle policies do not have that coverage, though medical payments can be added. Do not schedule an umbrella as if the $3,000 benefit is liability insurance, and do not assume a motorcycle policy failed because the no-fault line is absent.[^2]

### The sample quotes in the comparison guide are not the legal minimum

The same guide’s premium examples assume bodily injury of $50,000 per person and $100,000 per accident and property damage of $50,000. Those are the limits used to compare prices. The legal minimums are printed later: $25,000 and $65,000 bodily injury, $15,000 property damage, and $3,000 personal injury protection. Buy the umbrella over the policy that was actually issued, and do not treat the sample quote as the statute.[^2]

## Who Regulates Insurance in Utah

**Utah Insurance Department.** The Utah Insurance Department regulates licensed insurance companies and producers, offers a public licensee search, and accepts complaints about property/casualty insurance.
