# Texas Umbrella and Excess Liability Guide

Transportation Code section 601.072(a) is expired. Subsection (a-1), effective January 1, 2011, sets the minimum motor vehicle liability insurance that establishes financial responsibility under that chapter: $30,000 for bodily injury to or death of one person in one collision, $60,000 for two or more persons, subject to the one-person amount, and $25,000 for damage to or destruction of property of others. The policy may exclude the first $250 of bodily-injury liability for one person, the first $500 for two or more persons, and the first $250 of property damage. Civil Practice and Remedies Code section 41.008 then limits exemplary damages to the greater of two amounts: two times economic damages plus noneconomic damages not exceeding $750,000, or $200,000. The section does not apply to exemplary damages based on specified Penal Code felonies. ## What Is Umbrella And Excess Liability?

Umbrella or excess insurance adds liability limits above the policies named in the quote after a covered claim exhausts their limits. ## What to Watch for in Texas

### The statute allows a small exclusion off the minimum, not a large deductible

Section 601.072(b) says the required coverage may exclude, for one collision, the first $250 of bodily injury or death of one person, the first $500 for two or more persons subject to the one-person figure, and the first $250 of property damage. That is a permitted exclusion from the minimum, not permission to buy a $1,000 or $2,500 liability deductible and still claim the section is satisfied. Match the umbrella’s underlying-insurance schedule to the limits on the declarations after any exclusion the policy actually uses.[^1]

### Exemplary damages use the greater of two formulas

Section 41.008(b) says exemplary damages may not exceed the greater of two times economic damages plus noneconomic damages found by the jury, with that noneconomic add-on not to exceed $750,000, or $200,000. Subsection (a) requires the trier of fact to find economic damages separately from other compensatory damages. Size any punitive discussion against that greater-of test. The $200,000 alternative matters when two times economic damages plus the allowed noneconomic amount is smaller than $200,000.[^2]

### Listed Penal Code felonies are outside the exemplary-damages cap

Section 41.008(c) says the section does not apply when the plaintiff seeks exemplary damages based on conduct described as a felony in listed Penal Code sections, if, except for sections 49.07 and 49.08, the conduct was committed knowingly or intentionally. The list includes murder, capital murder, aggravated kidnapping, aggravated assault, sexual assault, injury to a child, elderly individual, or disabled individual with a health-care exception, specified fraud and theft felonies, intoxication assault, and intoxication manslaughter, and it continues past those items. Read the full list before treating $750,000 or $200,000 as the ceiling.[^2]

## Who Regulates Insurance in Texas

**Texas Department of Insurance.** TDI licenses agents and insurers, reviews company rate filings, and investigates complaints against insurance companies and people it regulates. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4.85% of gross premium plus 0.04% SLTX stamping fee When Texas is the insured’s home state, the state tax is 4.85% of gross premium; absent a compact allocation agreement, a multistate policy can be taxed on its entire premium. Policies effective on or after Jan. 1, 2024 also carry a 0.04% stamping fee; SLTX invoices the broker and says the insured pays it, and the surplus-lines insurer is not covered by the Texas guaranty association.[^6][^7][^8]
