# Pennsylvania Umbrella and Excess Liability Guide

Title 75, section 1702, defines financial responsibility as the ability to respond in damages for liability from the maintenance or use of a motor vehicle: $15,000 because of injury to one person in any one accident, $30,000 because of injury to two or more persons, and $5,000 because of damage to property of others. The form has to be acceptable to the Department of Transportation. PennDOT’s February 2025 insurance fact sheet repeats those three amounts for a currently registered vehicle and describes what happens when coverage lapses. A lapse suspends the registration privilege for three months unless the lapse was under 31 days and the owner proves the vehicle was not operated. Once in a 12-month period, the owner may pay a $500 civil penalty under Vehicle Code section 1786(d)(1.1) instead of serving that suspension, plus a restoration fee and proof of current insurance. An umbrella does not supply this financial-responsibility form by itself.[^1][^2]

Umbrella or excess insurance adds liability limits above the policies named in the quote after a covered claim exhausts their limits. ## Pennsylvania Requirements

| Financial-responsibility amounts for a registered vehicle | Section 1702 sets $15,000 for injury to one person, $30,000 for injury to two or more persons, and $5,000 for property damage. PennDOT’s fact sheet uses the same three figures as the liability insurance a registered vehicle must carry. They are not an umbrella minimum. A 2025 House bill that would raise the property figure to $25,000 is not the compiled statute.[^1][^2] |

## What to Watch for in Pennsylvania

### Property damage in the definition is $5,000

Section 1702’s property amount is $5,000 because of damage to property of others in any one accident, not a five-figure property limit. An umbrella that requires $25,000 or $50,000 of underlying property damage will not attach over a policy written only to section 1702. Ask for the declarations, not the statutory floor, before you set the attachment point.[^1]

### A lapse suspends the registration unless a short unused gap is proved

PennDOT says a lapse suspends the registration privilege for three months. The exception is a lapse of less than 31 days where the owner or registrant proves the vehicle was not operated. The plate, card, and driver’s license if applicable must be surrendered to serve the suspension. Restoration takes a fee and proof of insurance. The underlying policy the umbrella follows has to be the one that is actually in force, not a policy that lapsed and left the registration suspended.[^2]

### The $500 civil penalty is available once in twelve months

Instead of serving the registration suspension, Vehicle Code section 1786(d)(1.1) allows a $500 civil penalty, plus the restoration fee under section 1960 and proof of current insurance. PennDOT says that option may be used no more than once in a 12-month period. Paying the penalty does not increase the $15,000, $30,000, and $5,000 liability amounts in section 1702.[^2]

## Who Regulates Insurance in Pennsylvania

**Pennsylvania Insurance Department.** The Pennsylvania Insurance Department publishes state tools to check licensed producers, agencies, and insurers, and its Consumer Services Online portal accepts complaints about insurers, agents, brokers, and public adjusters. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premium (2% for eligible surplus-lines risk retention groups) Pennsylvania charges 3% of gross surplus-lines premiums (2% for an eligible surplus-lines risk-retention group); the tax is in addition to premium, is borne by the insured, and is collected by the producer. For multistate risks, the 2025 Revenue instructions say all gross premiums are taxable when Pennsylvania is the home state, while Insurance Company Law §1621(d) says tax is levied only on premium reasonably ascribable to Pennsylvania risk; confirm allocation with your producer or the state. Surplus-lines coverage is excluded from the guaranty association, and qualifying large risks or exempt commercial purchasers may use distinct no-search routes, with the ECP route requiring disclosure and written request.[^6][^7][^8][^9]
