# Nebraska Umbrella and Excess Liability Guide

Nebraska Revised Statute 60-501 sets financial-responsibility amounts of $25,000 for bodily injury or death of one person, $50,000 for two or more persons, and $25,000 for injury to property of others. Section 25-21,185.09 then bars the claimant entirely when the claimant’s contributory negligence is equal to or greater than the total negligence of all persons against whom recovery is sought. Damages are otherwise reduced rather than denied. An umbrella sitting above a Nebraska auto policy should assume the $25,000/$50,000/$25,000 floor, and a claim file should not assume that equal fault still produces a reduced judgment.[^1][^2]

## What to Watch for in Nebraska

### Equal negligence is a complete bar

Section 25-21,185.09 says contributory negligence does not bar recovery except when the claimant’s contributory negligence is equal to or greater than the total negligence of all persons against whom recovery is sought. In that case the claimant shall be totally barred. The jury is instructed on the effects of the allocation. A 50 percent claimant finding is not a diminished verdict under this section. It is no recovery.[^2]

### The comparison is against everyone from whom recovery is sought

The statute compares the claimant with the total negligence of all persons against whom recovery is sought, not with each defendant in isolation. Adding or dropping a defendant can change whether the claimant is equal to that total. Ask counsel who is in that group before you decide the excess layer has no exposure.[^2]

### Keep the umbrella schedule at or above the three statutory amounts

Section 60-501’s amounts are $25,000, $50,000, and $25,000. An excess form that warrants a higher underlying limit is a policy condition, not a change to the statute. If the auto policy is written at the statutory floor, confirm the umbrella will accept that floor or quote the gap.[^1]
