# Maine Umbrella and Excess Liability Guide

MaineDOT’s current consultant procurement instructions ask for $1 million per claim and aggregate professional liability, $1 million per occurrence/$2 million aggregate CGL naming MaineDOT as an additional insured, $1 million auto, workers’ compensation under Maine law, and excess/umbrella liability if applicable; the agency may consider a waiver request where the minimums cannot be met. For competitively bid public construction, Maine law bars public officials from requiring a bidder to obtain insurance from a particular insurer, agent, or broker. These rules do not eliminate project-specific limits: check the latest contract conditions and distinguish professional errors-and-omissions from a commercial umbrella.[^1][^2]

## What Is Umbrella And Excess Liability?

Umbrella or excess insurance adds liability limits above the policies named in the quote after a covered claim exhausts their limits. ## What to Watch for in Maine

### MaineDOT’s professional-liability minimum is a separate line

The consultant schedule names $1 million professional liability per claim and annual aggregate separately from $1 million/$2 million CGL and says excess/umbrella is if applicable. If you perform design, engineering, or other professional services, do not use the umbrella limit as proof of E&O coverage; verify whether a contract waiver is available and how claims-made continuity is handled.[^1]

### A waiver must be requested and approved

MaineDOT says consultants who do not meet the minimum insurance requirements must submit certificates with an Insurance Waiver Request Form for agency approval. A quote or certificate that shows lower limits does not itself amend the solicitation. Submit the form before contract execution and retain the agency’s decision with the final contract schedule.[^1]

### Maine restricts which insurer a public buyer can dictate

Section 2180 covers competitively bid public building/construction contracts and projects wholly or partly financed with public funds. It prohibits the public official from forcing procurement from a specific insurer, agent, or broker, but it does not excuse the bidder from meeting a contract’s coverage and limits. If a bid names a market or broker, distinguish that issue from the requested umbrella limits and seek procurement guidance.[^2]

### Public construction records track who insures each contractor’s employees

Maine’s workers’ compensation statute requires the general contractor or construction manager on projects undertaken by the State, University of Maine System, or Maine Community College System to give the board a list of subcontractors and independent contractors and identify the entity that insures each for workers’ compensation. This is a workforce-insurance disclosure, not an umbrella requirement; check it separately when collecting subcontractor liability certificates.[^3]

## Who Regulates Insurance in Maine

**Maine Bureau of Insurance.** The Maine Bureau of Insurance licenses producers and companies, enforces Maine insurance laws, and investigates property and casualty complaints including commercial coverage complaints. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross direct premium when Maine is the insured's home state Maine charges 3% of gross direct premium when it is the insured's home state; your broker handles the tax and may include it with the premium. Surplus-lines policies are outside Maine guaranty-association protection. Maine generally requires a diligent search, with an exempt-commercial-purchaser exception requiring broker disclosure and the purchaser's written request.[^7][^8][^9]

## Umbrella And Excess Liability in Maine: FAQ

### Does MaineDOT require every consultant to carry an umbrella?

Its current instructions list excess/umbrella liability as ‘if applicable’ and allow a waiver request when minimum requirements cannot be met. The actual contract and approved waiver determine what applies to that consultant engagement.[^1]

### Can a Maine public construction bid require a particular umbrella insurer?

For competitively bid public-building/construction projects, including projects financed with public funds, §2180 prohibits officials from requiring insurance from a particular company, agent, or broker. It does not remove the project’s limits or coverage requirements.[^2]
