# Idaho Umbrella and Excess Liability Guide

Idaho’s Division of Occupational and Professional Licenses says registered general contractors must show at least $300,000 single-limit general liability that includes products and continued operations, plus workers’ compensation proof or an explanation why it is not required. An Idaho Transportation Department building-renovation contract dated May 2024 uses a higher combined CGL/umbrella limit and requires the contractor to keep the named project aggregate available. Treat the first as a registration rule and the second as one contract’s terms; neither establishes the limit for your job.[^1][^2]

Umbrella or excess insurance adds liability limits above the policies named in the quote after a covered claim exhausts their limits. ## What to Watch for in Idaho

### The $300,000 rule is narrow

DOPL’s cited requirement is framed for registered general contractors; the statute and regulator page do not establish a blanket excess-insurance mandate for every Idaho business or contractor specialty. Confirm the contractor category and the license or registration rule that actually applies before treating this threshold as a legal minimum.[^1]

### A project aggregate can matter as much as the occurrence limit

The May 2024 ITD building contract says the CGL’s general aggregate applies separately to that project location. That protects the project’s stated aggregate availability under the contract, but it does not by itself show whether your separate umbrella aggregate is project-specific; ask for the endorsement at each layer named in your contract.[^2]

### Keep completed work in the schedule review

Idaho’s contractor-registration documentation expressly includes products and continued operations. The ITD contract separately calls for completed-operations liability and requires qualifying claims-made coverage to continue or receive a two-year tail. For renovation or installation work, ask how long completed operations remain covered and whether the excess follows the same basis.[^1][^2]

### Transporting hazardous waste changes the auto question

The ITD contract’s auto clause calls for pollution coverage equivalent to the cited pollution-broadened auto endorsement and an MCS-90 endorsement when hazardous waste will be hauled. If your project includes that transport, identify the hauling subcontractor and its auto/pollution evidence; a general umbrella limit does not establish those specific terms.[^2]

## Who Regulates Insurance in Idaho

**Idaho Department of Insurance.** The Idaho Department of Insurance administers insurance laws and regulates insurers and licensed producers. It directs users to the NAIC State Based Systems lookup for producer and company licensing records and accepts consumer complaints.[^3][^7][^4]
