# Florida umbrella and excess liability: follow the project specification

A Charlotte County bridge-maintenance bid allows a following-form umbrella/excess to meet its own liability minimums, but its $3 million tier is internally unclear at exactly $10 million: the heading says “greater than” while the cost band begins at $10 million. Umbrella or excess insurance adds liability limits above the policies named in the quote after a covered claim exhausts their limits. ## What to Watch for in Florida

### Check that the excess policy actually follows the required form

The county bid allows excess only on a following-form basis and separately requires additional-insured, waiver, primary/noncontributory and cross-liability terms. Compare the umbrella endorsements to each clause; the certificate alone does not prove they match.[^1]

### Do not generalize one county bid to the state

This is the 2024 Charlotte County bridge-maintenance bid, not a Florida-wide limit. Its $3 million GL tier has a boundary conflict: the heading says projects greater than $10 million, but its table band starts at $10 million. Get the County’s written interpretation for a project estimated at exactly $10 million; use your own owner’s schedule for other projects.[^1]

### Include subcontractors and marine operations in the submission

The county bid applies requirements to subs and calls for USL&H/Jones Act endorsements on navigable-water work. Florida also requires contractors to collect subcontractor WC evidence, with liability exposure if a subcontractor has not secured payment.[^1][^3]

No. The $3 million figure appears in one Charlotte County bid for projects in a stated cost band; the heading and band conflict at exactly $10 million. It is not a general Florida rule. Obtain County clarification for a $10 million project and check the contract governing your own work.[^1]

### What happens if a Florida subcontractor lacks workers’ compensation?
