# Illinois trucking insurance: separate liability from cargo filings

The Illinois Commerce Commission requires a Public Carrier Certificate for intrastate for-hire property hauling other than household goods. The ICC’s cargo affidavit makes a specific narrow exception: a carrier that will not transport freight or drive-away vehicles valued above $5,000 may request a waiver, but must notify each shipper in writing before service. The public-liability and cargo filings are separate; neither establishes broader policy benefits.[^3][^1][^2]

## What Is Trucking?

Trucking coverage can address liability, damage to your trucks and cargo losses, but one quote may not include all three. If you haul goods for customers or yourself, compare those protections and check whether the quote needs motor-carrier or other commercial auto coverage. ## Illinois Requirements

| Requirement | Details |

| Intrastate public-carrier certificate | For-hire transport of property other than household goods over Illinois public roads in intrastate commerce requires an ICC Public Carrier Certificate. Federal authority does not substitute for this specifically intrastate state certificate.[^3] |
| Cargo filing and $5,000 threshold | ICC guidance requires insurer-filed Form H for cargo. For ordinary cargo, the ICC schedule lists $5,000 per vehicle and $10,000 aggregate at one time; the CA-1 affidavit says carriers handling any for-hire shipment worth more than $5,000 must file Form H with at least $10,000 coverage. The waiver is only for carriers that do not and will not transport any vehicle cargo valued over $5,000 or perform a for-hire drive-away of a vehicle over that value.[^1][^2] |

## What to Watch for in Illinois

### A cargo waiver does not remove customer-facing duties

The cargo affidavit conditions waiver on written notice to each shipper, before any transportation service, that minimum cargo insurance is not in place. If loads or drive-away vehicles may exceed $5,000, do not assume a waiver remains available.[^2]

### Household goods use a different authority path

The ICC Public Carrier Certificate page expressly excludes household goods. Confirm whether the operation is ordinary property freight or a household-goods move before selecting forms; household-goods credentials and rules are separate.[^3][^4]

### Use the actual freight and vehicle table

ICC liability amounts vary by GVWR and cargo class, including special hazardous-material tiers. Bring each vehicle’s rated weight and exact commodities to the insurance filing rather than selecting the non-hazardous amount by default. Cargo values and liability classes answer different questions.[^1]

## Who Regulates Insurance in Illinois

**Illinois Department of Insurance.** The Department licenses and oversees insurers and insurance producers doing business in Illinois, reviews regulated insurance activity, and investigates complaints about coverage, claims, premiums, and sales.[^5][^7][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3.5% of taxable premium plus a 0.04% stamping fee; separate 1% fire marshal tax on taxable fire premium When Illinois is the insured’s home state, the broker reports and remits a 3.5% tax on gross taxable surplus-line premium less returned taxable premium. The separate SLAI stamping fee is 0.04% for policies effective on or after January 1, 2023; a 1% fire marshal tax also applies to taxable fire premium.[^9][^8][^12][^13][^10]

**Illinois guaranty fund limits:** For covered claims against a member insurer, the Illinois Insurance Guaranty Fund generally caps its obligation at $500,000 per claim; workers’ compensation claims are excepted from that dollar cap. This fund does not protect policies issued by nonadmitted surplus-lines insurers. The net-worth exclusions apply to covered claims against member insurers.[^10]

**Illinois FAIR Plan:** If you cannot obtain basic property coverage in the voluntary market, the Illinois FAIR Plan offers a residual-market option for eligible property. Check its current eligibility and coverage limits before relying on it for a commercial location.[^11]

### Does a Form E filing cover cargo?

No. ICC materials distinguish Form E liability from Form H cargo. A filed form is evidence for a regulatory requirement; review the issued policy and cargo endorsements for what freight, values, causes of loss and transit stages are covered.[^1]

### When can an Illinois carrier use the cargo waiver affidavit?

Only if it does not and will not transport cargo worth more than $5,000 in any vehicle or perform a for-hire drive-away of a vehicle worth more than $5,000. The affidavit also requires written pre-service notice to each shipper that the minimum cargo coverage is absent.[^2]
