# Idaho trucking insurance: classify the load, carrier and route

Idaho’s current rules set public liability/property-damage financial-responsibility levels for common, contract and interstate carriers, with higher single-accident amounts for specified hazardous loads and a separate $750,000 level for other property carriers. ITD’s current forms distinguish intrastate haul-for-hire from interstate operation and call for different proof filings. These rules concern financial responsibility for injury, death and other people’s property; they do not establish cargo or truck physical-damage benefits.[^1][^2][^3]

## What Is Trucking?

Trucking coverage can address liability, damage to your trucks and cargo losses, but one quote may not include all three. If you haul goods for customers or yourself, compare those protections and check whether the quote needs motor-carrier or other commercial auto coverage. ## What to Watch for in Idaho

### A liability filing does not insure customer freight

The rule’s stated purpose is injury to people and damage to property other than the insured. It does not establish cargo insurance or protect the carrier’s own truck. Ask separately about cargo-in-transit limits, commodities, values, unattended vehicles and physical damage.[^1]

### Hazmat limits turn on exact commodity and capacity

The $5 million tier includes specified explosives, toxic material, certain radioactive quantities, bulk gases and hazardous substances in tanks over 3,500 gallons; the $1 million tier includes other listed oil and hazardous materials. Verify the current classifications and actual tank capacity rather than using a generic “hazmat” label.[^1]

### Match each unit to its actual operation code

The 2025 ITD application distinguishes farm, exempt, private, haul-for-hire and interstate use, and says proof is required for haul-for-hire. A route that crosses a state line or is part of interstate operation should not be described as Idaho-only intrastate.[^3][^2]

## Who Regulates Insurance in Idaho

**Idaho Department of Insurance.** The Idaho Department of Insurance administers insurance laws and regulates insurers and licensed producers. It directs users to the NAIC State Based Systems lookup for producer and company licensing records and accepts consumer complaints.[^4][^8][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 1.5% of premium when Idaho is the home state for property and casualty coverage Idaho’s surplus-lines tax is 1.5%. For property-and-casualty insurance other than workers’ compensation, if Idaho is the insured’s home state the full premium is taxed regardless of where covered risks are located; other lines follow the statutory allocation rule. Surplus-lines policies do not receive Idaho guaranty-association protection.[^6][^7][^9]

### Does an Idaho Form E prove my cargo is insured?

No. ITD’s liability filing requirements and the rule’s financial-responsibility schedule address liability risks. Ask for the actual cargo form and policy language if you need protection for freight in your care.[^2][^1]

### Do private carriers use the same Idaho limits as common carriers?

The current rule gives private carriers a separate instruction: maintain insurance under Idaho Code §49-1229, except that specified risky or perilous cargoes use the rule’s higher schedule. Confirm classification and freight facts with ITD.[^1]
