# Trucking Insurance in Delaware

Delaware adopts federal motor-carrier safety rules including Part 387, but Chapter 47 does not apply to an intrastate vehicle or combination at 26,000 pounds or less unless it carries placarded hazardous material or seats at least 16 people. The state DMV separately requires current liability-insurance proof with initial, renewal, or transfer applications for apportioned registration.[^1][^2]

## What to Watch for in Delaware

### Check Delaware's Intrastate Weight Cutoff

For a single vehicle or combination at 26,000 pounds or less operating intrastate, Delaware Chapter 47 says its adopted safety requirements do not apply, except when the vehicle carries placarded hazardous material or seats 16 or more people. That is a scope limit for this chapter, not proof that every other insurance or permit rule disappears.[^1]

### Confirm The Rule For Heavier Local Vehicles

Delaware adopts 49 CFR Part 387 as state motor-carrier safety law and its weight carveout is limited to vehicles at or below 26,000 pounds with two express exceptions. Give the agent the vehicle's gross and combination weight and intrastate route so the state adoption and any other authority requirements can be checked.[^1]

### Submit Insurance With The Delaware IRP Application

For a new IRP/IFTA carrier account, Delaware requires proof of insurance before it schedules an appointment. The 2026 application package specifies a Delaware-issued property-and-casualty policy, an insurance card listing Delaware, the NAIC code and accurate VIN, and a named insured matching the title and account.[^2]

### Refresh Proof When Adding An IRP Unit

Delaware's current new-carrier packet accepts a binder, declarations page, or policy for a leased-on truck only if its VIN appears in the detailed, signed lease. If you use another carrier's insurance or DOT credentials, give Motor Carrier Services the lease and confirm the required filing before registering the unit.[^2]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premium, less return premium, when Delaware is the home state When Delaware is the insured’s home state, its 3% surplus-lines premium tax applies to the entire premium of a multistate policy, less returned premiums and excluding federal and state taxes and examination fees. Ask the surplus-lines broker to confirm the home-state determination and tax calculation, and separately explain how exposures are allocated in the required reports; those allocations do not reduce the premium subject to Delaware’s tax.[^6][^7]
