A 2023–24 smart-meter services agreement filed with the Kentucky Public Service Commission tied a $5 million combined cyber and technology E&O limit to work performed under that agreement. The same agreement separately capped each party’s liability at payments under the applicable SOW or purchase order and excluded several damage categories. ### Put Owner Notice Into the Data-Hosting Plan

Kentucky KRS §365.732 requires an information holder that maintains covered personal information it does not own to notify the owner or licensee as soon as reasonably practicable after a qualifying breach.
