# Nevada Public Construction Bonds

Nevada requires surety security when public works contracts exceeding $100,000, excluding contracts under Chapter 408; performance and payment bonds each at least 50% of the contract amount. Nevada State Public Works Division can also require bonds from qualifying subcontractors whose work exceeds $50,000 or 1% of the project, whichever is greater.[^1][^2]

## What Is Surety Bonds?

A surety bond guarantees that your business meets a specific obligation to a customer, contracting party or government agency. If a contract, license or permit requires one, get its exact form and amount; a bond is not insurance for your own losses. [Read the national Surety bonds guide](/coverage/surety-bonds).

## Nevada Requirements

| Requirement | Details |
| --- | --- |
| Public construction security | Public works contracts exceeding $100,000, excluding contracts under chapter 408; performance and payment bonds each at least 50% of the contract amount.[^1] |

## What to Watch for in Nevada

### Check the Nevada Contract Trigger

Nevada law triggers public-work security when public works contracts exceeding $100,000, excluding contracts under Chapter 408. Performance and payment bonds each at least 50% of the contract amount Ask the contracting agency to confirm whether your project falls under this rule and to state the bond penal sum in the bid documents.[^1]

### Nevada Has Another Bond Rule for This Work

Before issuing a contractor license, the Nevada State Contractors Board sets a continuous bond or cash deposit from $1,000 to $500,000 based on financial and professional responsibility and business scale. Before binding the surety, match the required obligee, bond form, and covered obligation to this separate rule.[^2]

### Match the Solicitation’s Bond Form

The NRS 339.025 governs this statutory obligation, while the project solicitation identifies the obligee, filing deadline, and any bid-security details. Get the final form approved before the bid date and confirm that the named surety is authorized for Nevada work.[^1][^2]

## Who Regulates Insurance in Nevada

**Nevada Division of Insurance.** The Nevada Division of Insurance regulates insurers and producers and provides a license verification tool for agents, agencies and companies. Its Consumer Services unit accepts insurance complaints and questions.[^3][^4][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** Same tax rate as admitted coverage of the same kind; an approved filing fee may also apply When Nevada is the insured’s home state, Nevada taxes surplus-lines coverage at the rate imposed on similar admitted coverage and adds any approved filing fee; the rate therefore depends on the line and applicable fee approval. Nevada law requires a diligent effort to place coverage with authorized insurers except where the statutory exempt-commercial-purchaser conditions apply, and the policy must warn that the Nevada Insurance Guaranty Association will not cover the contract.[^6][^7][^8][^9]

## Providers With Documented State Licenses

These providers publish a national listing for Surety bonds; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in Nevada; [check the regulator’s license lookup](https://doi.nv.gov/licensing-search/) and confirm state availability for your business when requesting a quote.

- [TechInsurance](/insurance-providers/techinsurance) — **Entity:** Specialty Program Group LLC; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** TechInsurance’s current licensing page names Specialty Program Group LLC / SPG Insurance Solutions and lists state license numbers, but labels Rhode Island “Individual licenses” rather than identifying a license for the named agency. RI is omitted because this disclosure does not establish agency authority there; this is a search limitation, not an assertion that the company is unlicensed. The remaining state entries are company-reported and are not an insurance product availability map.[^15]

## Questions to Ask Before You Buy in Nevada

1. Which Nevada statute or procurement rule triggers this bond for our project, and what is the exact penal sum?
2. Will the obligee accept another form of security, and who must approve that substitution in Nevada?
3. What notice, filing, and claim deadlines should our subcontractors and suppliers track under this bond?
