# Idaho Public Works Contractor Bonds

For a publicly funded Idaho project whose total estimated cost is at least $50,000, the DOPL licensing program requires a Public Works Contractor license and Idaho Code §54-1926 requires performance and payment bonds before the covered public contract is executed. The public body sets each penal sum, but each must be at least 85% of contract price.[^1][^2]

## What Is Surety Bonds?

A surety bond guarantees that your business meets a specific obligation to a customer, contracting party or government agency. | Project bond threshold | Before a public contract of $50,000 or more to construct, alter, or repair a public building, public works, or public improvement is executed, the contractor furnishes performance and payment bonds.[^1][^2] |
| Minimum penal sums | The public body fixes each bond amount, but Idaho Code §54-1926 sets a minimum of 85% of the contract for both performance and payment bonds.[^1] |
| License class and bid ceiling | DOPL assigns a license type for the work and a class based on financial and completed-project factors; the class determines the maximum project amount that may be bid.[^2] |

## What to Watch for in Idaho

### Use the whole-project estimate

DOPL describes the licensing trigger by the estimated cost of the entire publicly funded project, not merely one contractor’s bid package. Public funding and project scope therefore matter before estimating the bond requirement.[^2][^1]

### Public and private work diverge

The DOPL FAQ says private residential and commercial work does not require a Public Works Contractor license; its rule applies to work involving public funding and an authorized public awarding body. Do not apply the public-works threshold to an ordinary private job.[^2]

### Confirm the obligee and claimant group

The performance bond protects the public body; the payment bond solely benefits labor, material, equipment, and rental providers. A private customer’s requested bond is a separate contract question.[^1]

## Who Regulates Insurance in Idaho

**Idaho Department of Insurance.** The Idaho Department of Insurance administers insurance laws and regulates insurers and licensed producers. It directs users to the NAIC State Based Systems lookup for producer and company licensing records and accepts consumer complaints.[^3][^7][^4]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 1.5% of premium when Idaho is the home state for property and casualty coverage Idaho’s surplus-lines tax is 1.5%. For property-and-casualty insurance other than workers’ compensation, if Idaho is the insured’s home state the full premium is taxed regardless of where covered risks are located; other lines follow the statutory allocation rule. Surplus-lines policies do not receive Idaho guaranty-association protection.[^5][^6][^8]

## Surety Bonds in Idaho: FAQ

### Can a smaller project still require security?

Yes. The public body may set a bond amount in contracts below $50,000, and the licensing statute allows alternative government obligations in lieu of a commercial surety in specified circumstances. Check the contract and awarding body.[^1]

### Does a bond increase my license bid limit?

No. DOPL says license class determines the amount a contractor may bid; bonding the obligation does not itself change the class ceiling.[^2]
