# Business Insurance in New Mexico

## Insurance Regulator

**New Mexico Office of Superintendent of Insurance.** New Mexico OSI licenses insurance producers and agencies, oversees insurers and reviews insurance forms and rates. Its Consumer Assistance Bureau accepts insurance complaints, including complaints involving commercial and business insurance.[^1][^2][^3][^4]

## Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3.003% of taxable surplus-lines premium (verify allocation and current return instructions) New Mexico’s surplus-lines tax is listed as 3.003% of taxable premium in the state’s surplus-lines tax-return instructions; confirm current allocation and filing treatment with the New Mexico Taxation and Revenue Department because its current program page distinguishes broker-placed surplus lines from independently procured insurance. Surplus-lines coverage is issued by an unauthorized insurer and is outside ordinary state guaranty-association protection; do not treat the separate self-procured tax as the surplus-lines broker tax.[^5][^6][^7][^8]

## Coverage Guides

- [General Liability Insurance in New Mexico](/coverage/general-liability/new-mexico): New Mexico generally assigns each tort defendant only its share, but an employer can remain jointly liable for fault attributed to an employee acting within the vicarious-liability relationship.
- [Directors and Officers (D&O) Insurance in New Mexico](/coverage/directors-officers/new-mexico): See New Mexico’s compensation-based director liability thresholds and the business-corporation indemnity standard.

- [Media Liability Coverage in New Mexico](/coverage/media/new-mexico): New Mexico requires a timely and adequate correction request before a defamation action; a request made within 90 days of learning of publication preserves more than provable economic loss, and a sufficient correction can narrow damages.
- [New Mexico EPLI: Four-person coverage threshold and perfected-charge deadline](/coverage/employment-practices/new-mexico): New Mexico’s Human Rights Act generally defines an employer as a person with four or more employees, and the Human Rights Bureau requires a perfected complaint within 300 days.

- [New Mexico Business Owners Policy: Understand FAIR Plan Limits](/coverage/business-owners-policy/new-mexico): New Mexico's OSI describes a commercial FAIR Plan limit and cash-value basis. That limited property safety net does not replace the liability and income sections of a BOP.
- [New Mexico Umbrella and Excess Liability Guide](/coverage/umbrella-excess/new-mexico): MVD states the liability minimum as $25,000, $50,000, and $10,000, and a missing insurer report can suspend the registration after 30 days.

- [New Mexico garage liability for motor vehicle dealers](/coverage/garage-liability/new-mexico): See which New Mexico inventory vehicles can use dealer plates and what insurance proof is accepted.
