# Professional Liability (E&O) Insurance in Texas

Texas real-estate inspectors must maintain financial responsibility through a policy with at least $100,000 per occurrence and $100,000 annual aggregate that specifically covers professional liability for violations of Occupations Code Subchapter G, or through a Commission-accepted bond or other security. ## What to Watch for in Texas

### Check the Policy’s Statutory Scope

The insurance option must specifically provide professional-liability coverage to protect the public against violations of Subchapter G, Texas’s inspector prohibited-acts subchapter. Ask whether consulting, engineering, or other services outside the licensed inspection are included rather than reading the statutory minimum as broad coverage for all work.[^1]

### A Bond Is a Different Compliance Route

Texas permits a Commission-accepted bond or other security instead of the specified policy; a bond must be continuous and at least $100,000, with at least 90 days’ written notice to the Commission before cancellation. If you choose security instead of insurance, verify the Commission accepted the exact form and do not describe it to buyers as an E&O policy.[^1]

### Coordinate Changes With TREC

TREC rules require an inspector to keep proof during an active license and notify the Commission within 10 days after cancellation or nonrenewal. Make the reporting responsibility explicit in the broker relationship and keep the license status aligned with replacement coverage.[^2]

## Who Regulates Insurance in Texas

**Texas Department of Insurance.** TDI licenses agents and insurers, reviews company rate filings, and investigates complaints against insurance companies and people it regulates.
