# Professional Liability (E&O) Insurance in Mississippi

Mississippi requires active real estate licensees to obtain E&O, with an inactive-license exception and a group-policy option through the commission. For independent coverage, the commission's 2023 rule sets at least $100,000 per claim and limits the damages and defense-cost deductibles separately.[^1][^2]

**Coverage:** [Professional errors and omissions (E&O)](/coverage/professional-errors-omissions) · [Mississippi](/coverage/states/mississippi)

## What Is Professional Errors And Omissions (E&O)?

Professional liability can help pay defense costs and covered losses when a client says your advice or service caused financial harm. If customers rely on your work, list every service you provide and check the claims-made reporting and prior-work terms. [Read the national Professional errors and omissions (E&O) guide](/coverage/professional-errors-omissions).

## Mississippi Requirements

| Requirement | Details |
| --- | --- |
| Active real estate licensee E&O | Required; group or compliant independent policy; inactive licensees excepted[^1][^2] |
| Independent policy minimum | At least $100,000 per claim; damages deductible up to $2,500 and defense-cost deductible up to $1,000[^2] |

## What to Watch for in Mississippi

### Meet the New-Licensee Proof Deadline

Mississippi's rule gives a new licensee 30 days after license issuance to provide proof of coverage or pay the prorated group premium; otherwise the license changes to inactive status. Put the deadline on the onboarding checklist before accepting brokerage work.[^2]

### Confirm the Independent Carrier's Notice Commitment

The commission's independent-policy rule requires a non-cancelable policy or a carrier commitment to notify the commission 30 days before cancellation. Ask for that commitment with the certificate and confirm it applies to the policy you are buying.[^2]

### Compare the Two Deductibles Separately

The independent-policy limits cap the per-licensee, per-claim deductible at $2,500 for damages and $1,000 for defense costs. Request both terms in writing; one deductible amount does not prove compliance with the other cap.[^2]

### Confirm the Current Commission Rule

The independent-policy terms come from the commission rules compilation revised July 1, 2023, while its license-law compilation is revised August 15, 2025. Before renewal, confirm the commission has not amended Rule 9.3 since that rules edition.[^2][^1]

## Who Regulates Insurance in Mississippi

**Mississippi Insurance Department.** The Mississippi Insurance Department licenses agents and companies, enforces state insurance laws, and investigates insurance complaints. You can use its state lookup or complaint service to check a license or raise an insurance issue.[^3][^4][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4% premium tax and 0.25% stamping fee on gross premium and policy fees when Mississippi is the insured's home state; MSLA says do not report if Mississippi is not the home state unless 100% of premium is allocated to Mississippi. A separate 3% MWUA fee applies to gross premium and policy fees except residential flood and earthquake. For policies quoted or bound on or after July 1, 2017, Mississippi no longer requires a general diligent search before surplus-lines placement. If Mississippi is the insured's home state, the published charges are 4% premium tax and a 0.25% stamping fee on gross premium and policy fees, plus a separate 3% MWUA fee except for residential flood and earthquake; Mississippi's required policy notice says a nonadmitted insurer is not protected by the Mississippi Insurance Guaranty Association if it becomes insolvent.[^6][^7][^8][^9][^10]

## Providers With Documented State Licenses

These providers publish a national listing for Professional errors and omissions (E&O); the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in Mississippi; [check the regulator’s license lookup](https://www.mid.ms.gov/mississippi-insurance-department/licensing-search/) and confirm state availability for your business when requesting a quote.

- [At-Bay](/insurance-providers/at-bay) — **Entity:** At-Bay Insurance Services LLC; **role:** Insurance producer, Surplus-lines broker; **checked:** 2026-09-28. **Scope:** At-Bay’s license page lists P&C producer and surplus-lines broker license numbers for all 50 states and the District of Columbia. These are company disclosures and do not establish product availability in each jurisdiction.[^11]
- [Coalition](/insurance-providers/coalition) — **Entity:** Coalition Insurance Solutions, Inc.; **role:** Insurance producer, Surplus-lines broker; **checked:** 2026-09-28. **Scope:** Coalition’s license page lists producer and surplus-lines licenses for Coalition Insurance Solutions, Inc. in all 50 states and the District of Columbia. The page separately lists insurers; this record covers the brokerage entity only.[^12]
- [Corgi](/insurance-providers/corgi) — **Entity:** Corgi Insurance Services, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** Corgi’s company producer-license table lists 50 jurisdictions: 49 states and the District of Columbia, including DC license 3003091619. New Mexico does not appear in the table and is not included here; the omission does not establish that Corgi is unlicensed there. The company-reported table has no stated as-of date and does not establish product availability.[^13]
- [ERGO NEXT Insurance](/insurance-providers/next-insurance) — **Entity:** Next First Insurance Agency, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** ERGO NEXT’s current license table lists Next First Insurance Agency, Inc. in 50 jurisdictions, including Washington, DC; New York is excluded because its table rows name Next Insurance Services and AP Intego, not Next First. The table is company-reported; it does not establish product availability or provide state-regulator verification for each entry.[^15]
- [Hiscox](/insurance-providers/hiscox) — **Entity:** Hiscox Insurance Company Inc.; **role:** Insurer; **checked:** 2026-09-28. **Scope:** Hiscox’s U.S. company information states that Hiscox Insurance Company Inc. is licensed in all 50 states and the District of Columbia. This is company-reported insurer authority for this entity and does not establish which company issues every Hiscox-branded product.[^14]
- [TechInsurance](/insurance-providers/techinsurance) — **Entity:** Specialty Program Group LLC; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** TechInsurance’s current licensing page names Specialty Program Group LLC / SPG Insurance Solutions and lists state license numbers, but labels Rhode Island “Individual licenses” rather than identifying a license for the named agency. RI is omitted because this disclosure does not establish agency authority there; this is a search limitation, not an assertion that the company is unlicensed. The remaining state entries are company-reported and are not an insurance product availability map.[^16]
- [Vouch](/insurance-providers/vouch) — **Entity:** Vouch Specialty Insurance Services, LLC; **role:** Insurance producer, Surplus-lines broker; **checked:** 2026-09-28. **Scope:** Vouch’s licenses page, effective January 16, 2025, lists producer licenses in all 50 states and DC. Its separate surplus-lines table includes Idaho number 870820, while a footnote says Georgia and Idaho do not issue agency-level surplus-lines licenses. Because those statements conflict for Idaho, this record keeps Idaho producer-only and does not treat the table number as established agency surplus-lines authority. The page is company-reported and does not establish product availability.[^17]
