# Professional Liability (E&O) Insurance in Alaska

Alaska requires brokers, associate brokers, and salespersons to maintain E&O coverage for real-estate-licensed activities, through the commission master policy or qualifying equivalent. The commission’s September 2024 compilation sets minimums of $100,000 per covered wrongful act or claim and $300,000 aggregate per licensee, with defense expenses outside those limits. Check for later limit adjustments before relying on these figures for a 2026 placement.[^1][^2][^3]

## What Is Professional Errors And Omissions (E&O)?

Professional liability can help pay defense costs and covered losses when a client says your advice or service caused financial harm. If customers rely on your work, list every service you provide and check the claims-made reporting and prior-work terms. [Read the national Professional errors and omissions (E&O) guide](/coverage/professional-errors-omissions).

## Alaska Requirements

| Requirement | Details |
| --- | --- |
| Alaska Real Estate Licensee E&O | Required for brokers, associate brokers, and salespersons; September 2024 rule compilation: at least $100,000 per covered act/claim and $300,000 annual aggregate per licensee[^1][^2] |

## What to Watch for in Alaska

### File Equivalent Coverage on Time

Alaska permits an individual policy instead of the commission’s master policy, but the policy must meet the state’s equivalent-coverage standards. File the required certification with a license application or renewal; when replacing coverage, file before 5 p.m. on the date the old policy is canceled.[^2]

### Defense Costs Sit Outside the Limit

The minimum master-policy terms put investigation and defense expenses in addition to the per-claim limit. Ask whether a private equivalent policy does the same, and confirm any higher deductible or defense-cost retention you would have to fund.[^2]

### Check Tail and Prior-Acts Terms

The master-policy minimum includes a 90-day extended reporting period and an option to buy up to three additional years; it also requires prior-acts coverage to be offered when similar coverage has remained continuously in force. Compare those terms before switching insurers or leaving real-estate practice.[^2]

### Verify the Posted Limit Schedule

The commission’s linked statute-and-rule compilation is revised September 20, 2024, and 12 AAC 02.560 permits periodic coverage-limit adjustments. Check the current commission limit notice and policy before treating $100,000/$300,000 as the applicable 2026 minimum.[^2][^3]

## Who Regulates Insurance in Alaska

**Alaska Division of Insurance.** The Alaska Division of Insurance regulates insurers and insurance licensees, provides company and licensee searches, and investigates insurance complaints within its authority. Its consumer-services section handles disputes involving claims, cancellations, premium refunds, agents, and insurers.[^5][^6][^7]

- [License lookup](https://www.commerce.alaska.gov/web/ins/Consumers/ConsumerTools/ResearchaCompany.aspx)

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 2.7% of gross premium less returns plus 1% filing fee; wet marine: 0.75%, no fee For covered property and casualty surplus-lines risks, Alaska lists a 2.7% tax and a separate 1% filing fee on gross premium less returned premium. Qualifying wet-marine and transportation policies instead carry a 0.75% tax on gross premium and no filing fee; risks of state or local government and certain interstate aircraft are exempt from both tax and fee. A multistate placement is regulated under the insured’s home-state rules, and Alaska says to evaluate each policy’s home state separately.[^9][^8][^10][^11]

**Alaska has a placement-list exception:** If a risk appears on Alaska’s surplus-lines placement list, the Division says the broker does not have to canvass admitted insurers for declinations before placement; the broker must document the applicable list entry.[^8]

**Alaska has limited tax and search exceptions:** The Division says qualifying wet-marine and transportation policies need no diligent search and pay no 1% filing fee. Tax and filing fees also do not apply to state or political-subdivision risks or qualifying interstate aircraft, although other placement requirements remain.[^12]

## Providers With Documented State Licenses

These providers publish a national listing for Professional errors and omissions (E&O); the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in Alaska; [check the regulator’s license lookup](https://www.commerce.alaska.gov/web/ins/Consumers/ConsumerTools/ResearchaCompany.aspx) and confirm state availability for your business when requesting a quote.

- [At-Bay](/insurance-providers/at-bay) — **Entity:** At-Bay Insurance Services LLC; **role:** Insurance producer, Surplus-lines broker; **checked:** 2026-09-28. **Scope:** At-Bay’s license page lists P&C producer and surplus-lines broker license numbers for all 50 states and the District of Columbia. These are company disclosures and do not establish product availability in each jurisdiction.[^13]
- [Coalition](/insurance-providers/coalition) — **Entity:** Coalition Insurance Solutions, Inc.; **role:** Insurance producer, Surplus-lines broker; **checked:** 2026-09-28. **Scope:** Coalition’s license page lists producer and surplus-lines licenses for Coalition Insurance Solutions, Inc. in all 50 states and the District of Columbia. The page separately lists insurers; this record covers the brokerage entity only.[^14]
- [Corgi](/insurance-providers/corgi) — **Entity:** Corgi Insurance Services, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** Corgi’s company producer-license table lists 50 jurisdictions: 49 states and the District of Columbia, including DC license 3003091619. New Mexico does not appear in the table and is not included here; the omission does not establish that Corgi is unlicensed there. The company-reported table has no stated as-of date and does not establish product availability.[^15]
- [ERGO NEXT Insurance](/insurance-providers/next-insurance) — **Entity:** Next First Insurance Agency, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** ERGO NEXT’s current license table lists Next First Insurance Agency, Inc. in 50 jurisdictions, including Washington, DC; New York is excluded because its table rows name Next Insurance Services and AP Intego, not Next First. The table is company-reported; it does not establish product availability or provide state-regulator verification for each entry.[^17]
- [Hiscox](/insurance-providers/hiscox) — **Entity:** Hiscox Insurance Company Inc.; **role:** Insurer; **checked:** 2026-09-28. **Scope:** Hiscox’s U.S. company information states that Hiscox Insurance Company Inc. is licensed in all 50 states and the District of Columbia. This is company-reported insurer authority for this entity and does not establish which company issues every Hiscox-branded product.[^16]
- [TechInsurance](/insurance-providers/techinsurance) — **Entity:** Specialty Program Group LLC; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** TechInsurance’s current licensing page names Specialty Program Group LLC / SPG Insurance Solutions and lists state license numbers, but labels Rhode Island “Individual licenses” rather than identifying a license for the named agency. RI is omitted because this disclosure does not establish agency authority there; this is a search limitation, not an assertion that the company is unlicensed. The remaining state entries are company-reported and are not an insurance product availability map.[^18]
- [Vouch](/insurance-providers/vouch) — **Entity:** Vouch Specialty Insurance Services, LLC; **role:** Insurance producer, Surplus-lines broker; **checked:** 2026-09-28. **Scope:** Vouch’s licenses page, effective January 16, 2025, lists producer licenses in all 50 states and DC. Its separate surplus-lines table includes Idaho number 870820, while a footnote says Georgia and Idaho do not issue agency-level surplus-lines licenses. Because those statements conflict for Idaho, this record keeps Idaho producer-only and does not treat the table number as established agency surplus-lines authority. The page is company-reported and does not establish product availability.[^19]

## Questions to Ask Before You Buy in Alaska

1. Can we use our current private E&O policy as equivalent coverage, and what certification must be filed with the Alaska Real Estate Commission?
2. Are investigation and defense expenses outside our per-claim limit, and what deductible or retention would we pay?
3. If we stop or replace this policy, what extended reporting period and prior-acts protection will remain available?

## Professional Errors And Omissions (E&O) in Alaska: FAQ

### Do Alaska real-estate licensees need E&O insurance?

Yes. Alaska Statute § 08.88.172 and the commission’s posted rules require brokers, associate brokers, and salespersons to maintain E&O for activities requiring a real-estate license; the linked rule compilation is revised September 20, 2024.[^1][^2][^3][^4]

### Can an Alaska real-estate licensee use an individual E&O policy?

Yes. The rules allow qualifying independently obtained coverage if the licensee files the required certificate with the commission; the commission’s current FAQ also confirms that proof is required for renewal.[^2][^4]
