# Product Recall Insurance in Idaho

Idaho’s 2026 Direct-to-Consumer Commerce Act covers only specified homemade products sold by a producer or named agent to a final informed purchaser through an entirely in-state transaction; restaurant-style meals and most meat products fall outside the route, with listed exceptions and added dairy rules. For covered sales, sellers must give a prescribed inspection/licensing notice and keep specified records for two years, except animal-share sales use a contract or bill of sale.[^1][^2][^3][^4]

## What Is Product Recall?

Product recall insurance can pay specified costs to locate and withdraw a product after a covered problem. It fits businesses that could face recall logistics; product liability does not automatically pay those costs, so compare the trigger and covered expenses. ## What to Watch for in Idaho

### Separate Covered Products And Sales

Sections 37-203–205 define this route for homemade food grown, prepared, or processed at a farm, home kitchen, or other nonlicensed facility and sold by a producer or written-designated agent to a final informed consumer who does not resell; production through delivery must occur wholly in Idaho. Restaurant-style meals prepared for immediate consumption are outside “homemade.” Meat is generally excluded except enumerated poultry (including a 1,000-bird annual limit and own-raised/no-adulteration conditions), live animals or pre-slaughter shares, domestic rabbit, non-catfish farmed fish, and qualifying federally or otherwise approved-inspected meat. Ask the broker to schedule each covered and excluded product and channel separately.[^1][^3]

### Check Notice And Commodity Conditions

For sales under the chapter, §37-205 requires a conspicuous notice that the homemade product is not subject to government food-safety inspection or licensing, plus producer contact details and (for two or more ingredients) an ingredient list; perishable products also need safe storage/preparation instructions. Section 37-204 separately preserves applicable dairy and raw-milk requirements and bars use of chapter products as ingredients in a food establishment, including a public-school kitchen. Describe those conditions accurately in your application; they do not decide what the policy covers.[^2][^3]

### Keep Lot And Transaction Records

Section 37-208 requires product type and quantity, sale and production dates, production location, and ingredient origin/acquisition, retained for at least two years; animal-share transactions instead require the written contract or bill of sale, and records are confidential except for a confirmed foodborne-illness investigation. It does not require routine reporting, inspection, or submission absent that investigation. DHW says local public-health districts handle permits, inspections, and enforcement for licensed establishments. Ask whether your traceability records are adequate for affected lots and who will coordinate if products or facilities cross districts.[^4][^5]

## Who Regulates Insurance in Idaho

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 1.5% of premium when Idaho is the home state for property and casualty coverage Idaho’s surplus-lines tax is 1.5%. For property-and-casualty insurance other than workers’ compensation, if Idaho is the insured’s home state the full premium is taxed regardless of where covered risks are located; other lines follow the statutory allocation rule.
