# Product Recall Insurance in Florida

FDACS says Rule 5K-4002 adopts Part 117 for manufactured-food establishments, with exemptions and modified qualified-facility requirements; a written recall plan is required when a hazard analysis identifies a hazard requiring a preventive control. ### Recall-Plan Duties Depend on Facility Scope

FDACS says Part 117 applies through Rule 5K-4002 unless exempt or meeting modified qualified-facility requirements, and a written recall plan is required when the hazard analysis identifies a hazard requiring a preventive control. Confirm facility status before comparing the trigger.[^1]

### Do Not Move or Dispose of Embargoed Stock

Under §500.172 no person may sell, move, use, or dispose of detained or embargoed food until the department or court permits. Ask whether storage during a hold and later return, rework, or disposal are separate expenses.[^2]

### Condemnation Can Put Destruction Costs on the Claimant

If a court finds detained food in violation, §500.172 directs destruction or sanitation at the claimant’s expense under supervision, with a correction route for some labeling or sanitation violations and a bond. Compare this with policy salvage and disposal wording.[^2]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4.94% of gross premium plus a 0.03% FSLSO service fee for policies effective July 1, 2026 or later When Florida is the insured’s home state, Florida taxes the entire gross premium at 4.94%; the premium definition includes policy and similar insurance charges.
