# Product Recall Insurance in Arizona

Arizona’s manufactured-food rules effective April 6, 2026 incorporate 2023 Part 117 Subparts A, B, and F, while R9-8-903 says the state does not accept Subpart C. Separately, A.R.S. §36-910 allows detention of dangerous or fraudulent adulterated food and bars sale or disposal until release; match actual state and federal duties to the policy wording.[^1][^2]

### Check the April 2026 Rule Boundary

Arizona’s new Article 9 took effect April 6, 2026. R9-8-901 incorporates 2023 Part 117 Subparts A, B, and F; R9-8-903 expressly does not accept Subpart C. The state rule alone does not answer whether separate federal duties apply to your facility; identify the products and facilities in the quote.[^1]

### Detained Food Cannot Be Moved or Disposed

Under A.R.S. §36-910, the director may tag and detain food believed dangerous or fraudulent; no one may move or dispose of it until the director or court permits it. Ask whether storage during a hold and later destruction are separate expenses.[^2]

### Correction and Destruction Have Different Paths

Section 36-910 allows court-supervised processing or relabeling when a violation can be corrected; if not, the court orders destruction at the claimant’s expense. Compare rework and disposal wording separately.[^2]

## Who Regulates Insurance in Arizona

**Arizona Department of Insurance and Financial Institutions.** Arizona DIFI regulates insurance companies and insurance professionals, including producers and surplus-lines brokers. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premium and taxable policy fees, less returns; stamping fee rate not verified When Arizona is the insured’s home state, the tax is 3% of gross premium and taxable policy fees, less returned premium; the statute excludes stamping fees from that tax base. For a multistate risk, Arizona’s share is allocated by exposure under the statute. Arizona's surplus-lines policy notice says these policies do not receive guaranty-fund protection. **Arizona has an exempt-commercial-purchaser search exception:** A surplus-lines broker generally must make diligent effort to place an Arizona risk in the admitted market. For an exempt commercial purchaser, federal law removes that search only after the broker discloses the admitted-market protection difference and the purchaser then asks in writing for nonadmitted coverage.[^7][^9]

No. R9-8-903 says the department does not accept Subpart C requirements in its manufactured-food rule. This does not decide whether separate federal duties apply to a particular facility.[^1]

### Can a business dispose of food detained under Arizona law?

Not until the director or court permits removal or disposal. Section 36-910 distinguishes court-supervised correction from destruction when a violation cannot be corrected.[^2]
