# New Hampshire product liability insurance guide

New Hampshire’s product-liability chapter covers claims across negligence, strict liability, warranty, warning, marketing, and other theories. It generally requires suit within three years after injury is or should be discovered and sets a separate outside limit of twelve years after the final-product manufacturer last parted with possession and control or sold it. A lessor, bailor, or licensor with a legal inspection, maintenance, repair, modification, alteration, or improvement duty has a different outside-limit trigger; a later government-imposed duty has its own up-to-six-year rule without shortening the stated twelve-year periods. The statute has exceptions for specified fraud, written-contract, and UCC warranty claims. Product age, control, post-sale duties, claim type, and alteration records are key facts to discuss with counsel and a broker; they do not determine insurance coverage.[^1][^2]

## What to Watch for in New Hampshire

### The discovery period and outside limit both matter

RSA 507-D:2 requires commencement within three years after the injury is or should, with reasonable diligence, have been discovered, and also imposes an outside period of no later than twelve years after the manufacturer of the final product last parted with possession and control or sold it, whichever is later. Keep injury/discovery records and reliable manufacturing, sale, and control dates.[^1]

### A lessor’s duty can change the outside-limit trigger

For a lessor, bailor, or licensor legally required to inspect, maintain, repair, modify, alter, or improve the product, the twelve-year period runs from when that defendant ceases to have use, possession, or control, or ceases to be under the listed duty. Preserve lease and service terms, return dates, control records, and the end of any legal duty.[^1]

### A later government duty has a defined period

Where a claim rests on a government agency duty arising after the defendant parted with possession and control or sold the product, the statute allows no more than six years after the defendant first incurred that duty; this rule does not shorten the 12-year periods in the statute. Track recall, inspection, repair, and warning obligations and when each was imposed.[^1]

### The product-specific chapter overrides a different general clock

RSA 508:1 says that chapter 508 does not apply where a different time is limited by statute. Read that rule with RSA 507-D:2’s express product-claim periods before relying on a general personal-action deadline; identify whether the claim fits the product-liability chapter or one of its stated exceptions.[^3]

### Exceptions and alteration rules need fact-specific review

The statutory periods do not apply to specified claims based on fraudulent misrepresentation, concealment, or nondisclosure; written contractual obligations with a different limitation period; or listed UCC warranty claims that do not seek personal- or property-injury damages. Separately, RSA 507-D:3 limits liability to harm that would have occurred in the product’s unaltered condition, but ordinary wear and modifications made to defendant specifications or instructions are not treated as alteration under that section.[^1][^2]

## Who Regulates Insurance in New Hampshire

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% on the New Hampshire allocation; other-state allocations use those states’ rates and fees New Hampshire charges 3% on gross premium allocated to New Hampshire; for multistate coverage, premium allocated elsewhere is taxed at the rates and fees applicable in those jurisdictions, less qualifying returned premium. ## Product Liability in New Hampshire: FAQ

### Does New Hampshire’s three-year discovery period remove the twelve-year outside limit?

No. RSA 507-D:2 states both the three-year discovery-based period and a separate outside limit. A different trigger applies to a lessor, bailor, or licensor with a listed legal duty, and a later government-imposed duty has its own rule.[^1]

### Are all UCC warranty claims subject to RSA 507-D’s product time limits?

No. The statute excepts actions under the listed UCC warranty provisions that do not seek damages for injury to person or property; written contractual obligations with another limitation period are also excepted. Claim type and requested damages matter.[^1]
