# Missouri product liability insurance guide

Missouri defines a product-liability claim broadly by reference to strict liability, a product in the course of commerce, reasonably anticipated use, and a defect or warning issue. A seller whose only basis for liability is its place in the stream of commerce may seek dismissal when another defendant, including the manufacturer, is before the court and total recovery may be had; the motion involves a sworn statement and up to 60 days of discovery, and dismissal is without prejudice and interlocutory. Comparative fault can reduce damages but does not completely bar recovery under the statute. Map each company’s role, product traceability, manufacturer availability, and use/incident records for broker and counsel discussions; these statutes do not decide policy coverage.[^1][^2][^3]

## What to Watch for in Missouri

### The statutory product-claim definition is broad

Missouri defines a product-liability claim to include strict-liability claims against a person in the product’s course of commerce for harm caused by a product used in a reasonably anticipated manner, with an allegedly defective condition or inadequate warning. Preserve role, product-version, distribution, instructions, warning, and use records so counsel can assess which entities and theories are involved.[^1]

### Seller-only dismissal is conditional and procedural

A seller whose liability rests only on its place in the stream of commerce may move to dismiss if another defendant, including the manufacturer, is properly before the court and total recovery may be had from that defendant. The seller must submit a sworn affidavit stating it knows no facts supporting liability beyond seller status; parties then have 60 days for discovery on the motion. A qualifying dismissal is without prejudice, remains interlocutory until final disposition, and may be set aside for good cause.[^2]

### Keep evidence of any independent seller conduct

The statutory procedure turns on whether a basis for liability exists beyond seller status. Preserve records about private labeling, design input, warnings, assembly, inspection, modifications, repair, and communications; discuss with counsel how those facts affect a seller’s role and defense. The statute does not promise that a retailer or distributor will be dismissed.[^2]

### User conduct can reduce, not automatically defeat, recovery

For a product-liability claim, Missouri applies pure comparative fault. A defendant may prove specified user conduct—such as use not reasonably anticipated, unintended use, unreasonable exposure to a known danger, failure to take reasonable precautions, or failure to mitigate—and any assigned fault diminishes compensatory damages proportionately but does not bar recovery. Preserve warnings, instructions, training, maintenance, and incident evidence.[^3]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 5% of premium; Missouri taxes the entire gross premium when Missouri is the home state When Missouri is the insured’s home state, the state applies its 5% surplus-lines tax to the entire gross premium of a multistate policy; the regulator’s FAQ says the tax includes applicable fees. Eligible nonadmitted insurers do not participate in the Missouri Guaranty Fund, and Missouri generally requires the full amount or kind of coverage to be unavailable from admitted insurers before placement; an exempt commercial purchaser search exception has separate disclosure and written-request conditions.[^8][^9][^10][^11]

## Questions to Ask Before You Buy in Missouri

1. Which entities designed, imported, branded, assembled, distributed, sold, leased, repaired, or altered each product, and can we trace each product version to its manufacturer?
2. Can we promptly identify the manufacturer and determine whether a seller-only dismissal could even be considered, including whether total recovery may be had from another defendant?
3. Which records preserve the product’s anticipated use, warnings, instructions, maintenance, modifications, and incident circumstances for a comparative-fault analysis?
4. How do the proposed policy’s products-completed-operations terms, defense costs, limits, and exclusions apply to each role and product? Confirm from the actual policy form; Missouri liability statutes do not answer coverage.

## Product Liability in Missouri: FAQ

### Does Missouri automatically dismiss a retailer from a product case?

No. Section 537.762 creates a conditional motion procedure when the seller’s liability is based solely on its stream-of-commerce status, another defendant is properly before the court and total recovery may be had, and the statutory affidavit and discovery process support dismissal. Dismissal is without prejudice and can be set aside for good cause.[^2]

### Can a product user’s fault bar recovery in Missouri?

Section 537.765 abolishes contributory fault as a complete bar for product-liability claims and applies pure comparative fault. Proven fault can diminish compensatory damages proportionately.[^3]
