# Product liability in Kansas

Kansas lets a product seller prove that harm occurred after the product’s useful safe life; after ten years from first delivery to a consumer, the statute presumes that life has expired, subject to specified exceptions. Evidence about wear, storage conditions, ordinary use, repairs, warnings and product changes can matter. A separate two-year personal-injury period generally accrues when substantial injury occurs or becomes reasonably ascertainable, with a ten-year outside limit from the act, subject to statutory exceptions.[^1][^2]

## What to Watch for in Kansas

### Useful safe life depends on the product’s history

The seller may avoid liability if it proves by a preponderance that harm occurred after useful safe life expired. Kansas defines that life by how long the product would normally be likely to perform or be stored safely, and lists wear, climate, user practices, repair history, seller instructions or warnings, and modifications as especially probative evidence.[^1]

### Ten years raises a presumption, with express exceptions

For harm more than ten years after first consumer delivery, the statute presumes useful safe life expired; only clear and convincing evidence rebuts that presumption. A longer express safe-use warranty extends it, and the statute excludes specified substantial-causing concealment or misrepresentation, prolonged exposure, later-discoverable injury aspects and delayed manifestation.[^1]

### A separate limitation period may end earlier

Kansas’s general two-year period includes personal-injury claims. For the listed injury claims, accrual generally begins when the act first causes substantial injury, or when injury becomes reasonably ascertainable if that is later, but an action ordinarily cannot start more than ten years after the act. K.S.A. 60-3303 says it does not modify § 60-513 except for its stated latent-disease rules.[^1][^2]

### Surplus-Lines Tax and Stamping Office
