# Product liability in Iowa

Iowa Code § 614.1(2A) generally bars covered product claims more than 15 years after a product was first purchased, leased, bailed or installed for use or consumption. The rule covers specified claims for death, personal injury or property injury based on strict liability, negligence or implied warranty; a longer express warranty and specified concealment or latent-disease situations are treated differently. Iowa separately limits some strict-liability and implied-warranty claims against nonmanufacturer sellers when a solvent, jurisdictionally reachable manufacturer is available.[^1][^2]

## What to Watch for in Iowa

### The 15-year period uses the first-use transaction listed in the statute

For covered claims, the period runs from when the product was first purchased, leased, bailed or installed for use or consumption. The statute applies to specified death, personal-injury and property claims against listed product-chain roles, and to strict-liability, negligence and implied-warranty theories.[^1]

### The statute names specific exceptions

The 15-year limit does not displace a longer express warranty. It also does not apply if intentional misrepresentation or fraudulent concealment about the product substantially caused the harm. A separate latent-disease provision applies only to its defined harmful materials and discovery conditions; it is not a general exception for every delayed injury.[^1]

### Seller protections depend on role and manufacturer availability

A person who is not an assembler, designer or manufacturer and sells the product has statutory protection for strict-liability or implied-warranty claims based solely on an original design or manufacturing defect. Liability protection also depends on proof that the manufacturer is subject to Iowa-court jurisdiction and has not been judicially declared insolvent. A qualifying unidentified-manufacturer filing can toll the limitation period against that manufacturer.[^2]

## Who Regulates Insurance in Iowa

**Iowa Insurance Division.** The Iowa Insurance Division licenses insurance producers and maintains separate lists for licensed insurers and surplus-lines insurer categories. Its filing page routes most rate, rule and form filings through SERFF and identifies filings requiring prior approval; eligible surplus-lines insurers are not required to file or seek approval of their rates or forms.[^3][^9][^8][^4][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 0.925% of surplus-lines premiums when Iowa is the insured's home state, for 2026 When Iowa is the insured's home state, the 2026 premium tax is 0.925%, and the surplus-lines producer shall collect and pay it to the state in addition to gross premium. Placement generally requires an eligible surplus-lines insurer and a diligent search showing the full amount or type is unavailable from an admitted insurer; an exempt commercial purchaser may bypass that search only after the producer discloses that admitted insurance may be available and may offer greater protection and oversight, then the purchaser subsequently requests surplus-lines placement in writing.[^6][^7]

### What outside period does Iowa set for product claims?

For claims within § 614.1(2A), the action generally may not begin more than 15 years after first purchase, lease, bailment or installation for use or consumption, unless an express warranty runs longer. The section also contains specific concealment and latent-disease rules.[^1]

### Does Iowa treat every retailer as the product manufacturer?

No. Section 613.18 gives qualifying nonmanufacturer sellers protection against certain strict-liability and implied-warranty claims based solely on original design or manufacturing defects, subject to the statute’s manufacturer-jurisdiction and insolvency conditions.[^2]
