# Product liability in Georgia

Georgia imposes strict liability on manufacturers for injury caused by a product’s condition when sold. A ten-year repose period runs from the first sale for use or consumption; for repeated purchases of consumable products, the Georgia Supreme Court applies that period product by product. Preserve each unit’s sale and use records, and ask counsel which claims and products are in scope.[^1][^2]

## What Is Product Liability?

Product liability can cover claims that a product you make, import, distribute or sell injured someone or damaged property. If your business handles products, describe every role in the supply chain and ask how the quote treats product damage and recall costs. [Read the national Product liability guide](/coverage/product-liability).

## What to Watch for in Georgia

### Track each product unit

The Georgia Supreme Court held that the ten-year strict-liability period runs separately for each unit sold to an end user. For products bought repeatedly, keep purchase, lot, date and distribution records rather than relying on the first date the customer ever bought the brand.[^1][^2]

### The statute concerns the product’s condition when sold

Georgia’s Supreme Court describes the strict-liability rule as applying to manufacturers when a product causes injury because of its condition when sold. The case involved repeated sales of consumable products, so do not assume its unit-by-unit holding answers every product type or every theory of liability.[^1]

### The opinion addressed strict-liability claims

Burroughs interpreted the statutory ten-year rule for strict products-liability claims involving repeated sales of consumable products. The opinion’s per-unit holding should not be assumed to resolve a different claim theory or a different product pattern without legal review.[^1]

## Who Regulates Insurance in Georgia

**Georgia Office of Commissioner of Insurance and Safety Fire.** Georgia’s elected Insurance and Safety Fire Commissioner licenses and regulates insurance companies and insurance professionals, investigates insurance fraud, and oversees consumer complaint services. The Office’s state license lookup covers agents, agencies, and companies.[^3][^4][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4% of total premium when Georgia is the home state Georgia charges 4% on the total premium written and received by a surplus-lines broker when Georgia is the insured’s home state. Current fee treatment is not described here because the Department’s latest fee bulletin could not be retrieved as readable text; ask your broker for the policy-declaration and tax breakdown. This record does not state a Georgia-specific guaranty-fund conclusion.[^6]

## Providers With Documented State Licenses

These providers publish a national listing for Product liability; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in Georgia; [check the regulator’s license lookup](https://oci.georgia.gov/agents-agency-licensing) and confirm state availability for your business when requesting a quote.

- [Vouch](/insurance-providers/vouch) — **Entity:** Vouch Specialty Insurance Services, LLC; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** Vouch’s licenses page, effective January 16, 2025, lists producer licenses in all 50 states and DC. Its separate surplus-lines table includes Idaho number 870820, while a footnote says Georgia and Idaho do not issue agency-level surplus-lines licenses. Because those statements conflict for Idaho, this record keeps Idaho producer-only and does not treat the table number as established agency surplus-lines authority. The page is company-reported and does not establish product availability.[^13]

## Questions to Ask Before You Buy in Georgia

1. Which products do we manufacture, private-label, import, distribute, repair or sell in Georgia, and who keeps unit, lot and delivery records?
2. For each product, can we identify the date it was first sold for use or consumption and connect later claims to a particular unit?
3. Do our contracts allocate product-safety, recall, defense and indemnity responsibilities across manufacturers, importers, distributors and retailers?

## Product Liability in Georgia: FAQ

### Is there a ten-year product-liability cutoff in Georgia?

For strict-liability claims under O.C.G.A. § 51-1-11(b), the statute measures ten years from the first sale for use or consumption. The Georgia Supreme Court says that in repeated sales of consumable products, the period is applied separately to each unit.[^1]

### Does the per-unit rule answer every Georgia product claim?

No. The Georgia Supreme Court’s 2025 opinion applied the ten-year statute to strict-liability claims involving repeated sales of consumable units. Its holding should not be generalized to different theories or product patterns without claim-specific review.[^1][^2]
