# Product Liability in Connecticut

Connecticut generally requires a product-liability claim within three years after injury, death, or property damage is first sustained or discovered, or reasonably should have been discovered. It also generally bars a claim against a particular party more than ten years after that party last parted with possession or control of the product. The statute includes exceptions for harm during a product’s useful safe life, longer written warranties, fraud or intentional misrepresentation, and asbestos exposure. The product-liability act also channels product claims against sellers and excludes commercial loss from its definition of harm.[^1][^2]

## What to Watch for in Connecticut

### Track when harm and its cause became discoverable

The three-year period runs from when injury, death, or property damage is first sustained or discovered, or when reasonable care should have led to its discovery. Preserve incident, diagnosis, and investigation timelines and ask counsel to assess the date for the specific claim.[^1]

### Track the possession date for each party

The ten-year limit is measured separately from the date each party last parted with possession or control of the product. It has exceptions when the claimant proves the harm occurred during the product's useful safe life, when an express written warranty provides for use beyond ten years, and for intentional misrepresentation or fraudulent concealment that proximately caused the harm. Keep sale, delivery, return, repair, and warranty records rather than treating manufacture or first sale as the only relevant date.[^1]

### Separate bodily or property harm from commercial loss

Connecticut's product-liability act is in lieu of other claims against product sellers for harm caused by a product. Between commercial parties, commercial loss caused by a product is not harm recoverable through a product-liability claim; the statute directs those claims to the Uniform Commercial Code. Share customer and supplier contracts with counsel and ask your broker how the policy treats product-related financial losses.[^2]

### Note the deadline for bringing in another responsible party

A product seller may implead a third party who may be liable for all or part of the claim if the third-party complaint is served within one year after the original product-liability action is returned to court. Counsel should track this separate procedural deadline when the distribution chain includes other businesses.[^1]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4% of gross premium when Connecticut is the home state When Connecticut is the insured’s home state, surplus-lines tax is 4% of gross premium; certain state and local government insureds are exempt, and broker or policy fees are not part of the premium-tax base. Connecticut’s required notice says these policies are outside the state guaranty association. Most placements require three declinations or an export-list qualification; an exempt commercial purchaser may qualify for the federal § 8205 search exception after disclosure and a written request.[^6][^7][^8]
