# Virginia medical malpractice insurance guide

Virginia’s total-recovery limit is set by the date of the malpractice act, not the date a claim is filed; for acts from July 1, 2026 through June 30, 2027, the limit is $2.75 million. A joint underwriting association is activated only after a regulatory finding of market unavailability for a provider category.[^1][^2]

## What to Watch for in Virginia

### Use the act date, not the reporting date

For malpractice acts from July 1, 2026 through June 30, 2027, Virginia sets a total-recovery ceiling of $2.75 million; it rises to $2.8 million for acts from July 1, 2027 through June 30, 2028. The applicable figure follows the act date, so care-period records and policy dates matter.[^1]

### The schedule caps total recovery for an injury

Virginia’s statute limits total recovery for an injury to or death of a patient in covered malpractice actions. That damages limit is different from the policy’s per-claim and annual aggregate limits and does not establish that all insureds share separate limits.[^1]

### The state association is a conditional market

The Commission must investigate, provide notice and hold a hearing before activating the joint underwriting association for a provider class; it may stop operations if voluntary coverage becomes reasonably available. The association’s policies also have statutory maximum limits, so confirm present activation, eligibility and offered limits.[^2]

### Provider category affects fallback availability

The Virginia association statute defines health-care-provider categories and allows the Commission to add categories based on necessity to continued health-care delivery. Do not assume a practice or allied-health entity is eligible without checking the current order and plan.[^2]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 2.25% of premium plus up to 0.1% Bureau Special Fund assessment The NAIC's state chart lists a 2.25% of premium plus up to 0.1% Bureau Special Fund assessment charge for surplus-lines coverage for Virginia (the chart's state entries were reviewed in October 2025). Your broker may collect the applicable amount with the premium. Surplus-lines insurers are not licensed in the state and generally are outside state guaranty-association protection; ask your broker to explain the insurer's financial protections and any diligent-search requirement that applies to your placement.[^6][^7]

No. §8.01-581.15 says each annual increase applies to acts of malpractice occurring on or after its effective date.[^1]

### Can any provider assume Virginia’s joint underwriting association will insure them?

No. The Commission activates the association after a finding of market unavailability for a significant provider class, and it may later discontinue that class when coverage becomes reasonably available.[^2]
