# South Carolina medical malpractice insurance guide

South Carolina’s 2026 adjustment memorandum reports noneconomic-damages limits of $596,001 per health-care provider or institution and $1,788,002 combined per claimant. Economic damages remain outside those limits. Compare the figures and insured entities with the claim date, and plan for the state’s presuit notice and expert-affidavit steps.[^1][^2][^4][^3]

## What Is Medical Malpractice?

Medical malpractice insurance can pay defense costs and covered damages when a patient claims a clinician’s care caused harm. If you provide health care, match the quote to your practice, clinicians, specialties and procedures, then check who is insured. [Read the national Medical malpractice guide](/coverage/medical-malpractice).

## South Carolina Requirements

| Requirement | Details |
| --- | --- |
| Use the current indexed figure | The February 2026 memorandum reports $596,001 for each health-care provider or institution and $1,788,002 combined for each claimant. The limits are adjusted annually; confirm the State Register publication/effective date and apply the figure for the relevant claim.[^1][^2] |
| Separate noneconomic and economic damages | The statute limits noneconomic damages by provider/institution and sets a combined ceiling when multiple defendants are involved; it expressly does not limit economic damages.[^1] |

## What to Watch for in South Carolina

### The cap follows defendant categories

For 2026, the state’s adjustment memorandum reports $596,001 per provider or institution and $1,788,002 combined per claimant. The statute includes practices and other legal entities in its provider definition. Confirm the relevant judgment date, current State Register figure, and which clinicians, practice entities and facilities the policy insures.[^1][^2]

### The cap is not a total-damages ceiling

Economic damages are outside the noneconomic limit, and punitive damages may also be available under separate rules. Compare the policy’s per-claim and aggregate limits with the full potential loss, not only the noneconomic cap.[^1]

### Notice and expert support come before suit

South Carolina’s medical-liability process includes a notice of intent with an expert affidavit before filing suit, with statutory timing consequences. Ask counsel and the carrier how incident notice, investigation and defense coordination work during that presuit period.[^4]

### The association is a conditional market of last resort

Any licensed South Carolina health-care provider may apply to the Joint Underwriting Association, but acceptance depends on the Association’s underwriting standards and payment of premium. The legislature describes it as transitioning toward a market of last resort, not a patient-compensation fund; statutory policy limits are generally $1 million per claim/$3 million annual, with higher amounts requiring approval.[^3]

## Who Regulates Insurance in South Carolina

**South Carolina Department of Insurance.** The South Carolina Department of Insurance licenses and regulates insurance companies and producers and accepts complaints involving entities it licenses and policies incepted in South Carolina. Its consumer page links to the online complaint form and explains limits on the Department’s authority.[^5][^6][^7]

- [File a complaint](https://doi.sc.gov/consumers)

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 6% blended broker premium tax: 4% state plus 2% municipal SCDOI’s January 2026 instructions set a 6% blended surplus-lines broker premium tax: 4% state and 2% municipal; the Department collects both and the Municipal Association of South Carolina allocates the municipal share. The filing system also asks brokers to identify one to three insurers that declined the indicated coverage; check the policy notice for any guaranty-association disclosure.[^8][^9]

## Providers With Documented State Licenses

These providers publish a national listing for Medical malpractice; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in South Carolina; [check the regulator’s license lookup](https://online.doi.sc.gov/Eng/Public/Common/OnlineServices.aspx) and confirm state availability for your business when requesting a quote.

- [Corgi](/insurance-providers/corgi) — **Entity:** Corgi Insurance Services, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** Corgi’s company producer-license table lists 50 jurisdictions: 49 states and the District of Columbia, including DC license 3003091619. New Mexico does not appear in the table and is not included here; the omission does not establish that Corgi is unlicensed there. The company-reported table has no stated as-of date and does not establish product availability.[^12]
- [Vouch](/insurance-providers/vouch) — **Entity:** Vouch Specialty Insurance Services, LLC; **role:** Insurance producer, Surplus-lines broker; **checked:** 2026-09-28. **Scope:** Vouch’s licenses page, effective January 16, 2025, lists producer licenses in all 50 states and DC. Its separate surplus-lines table includes Idaho number 870820, while a footnote says Georgia and Idaho do not issue agency-level surplus-lines licenses. Because those statements conflict for Idaho, this record keeps Idaho producer-only and does not treat the table number as established agency surplus-lines authority. The page is company-reported and does not establish product availability.[^16]

## Questions to Ask Before You Buy in South Carolina

1. What is the currently published South Carolina noneconomic limit for the relevant claim date, and how does the policy limit apply across the clinician, practice and facility?
2. Are defense costs inside or outside each limit, and do economic or punitive damages erode the aggregate?
3. If applying to South Carolina’s Joint Underwriting Association, what underwriting standards, limits and claims-made or occurrence form are available for this provider class?

## Medical Malpractice in South Carolina: FAQ

### Does South Carolina’s cap limit every malpractice loss?

No. The statute limits noneconomic damages and expressly leaves economic damages outside that limit; its exceptions and punitive-damage rules also matter.[^1]

### Can a provider assume the state association will supply coverage?

Any licensed provider may apply, but the association must apply its underwriting standards and collect premium before issuing a policy; confirm acceptance, limits and form.[^3]
