# Maryland medical malpractice insurance: physician disclosure and settlement terms

Maryland requires a physician who practices in the state to disclose when medical professional liability coverage is absent or has lapsed; the law does not itself require every clinician or practice to buy a policy. Maryland policy language also gives the insurer settlement authority within its liability limit, while disciplinary-hearing defense may be a separately itemized purchase.[^1][^2]

## What to Watch for in Maryland

### Check which clinicians the statute reaches

Section 14-508 applies to a licensee practicing medicine in Maryland. Do not treat it as a statewide insurance mandate for every licensed health professional or the practice entity.[^1]

### Ask who controls settlement

A covered policy must authorize the insurer to negotiate and settle claims without restriction unless the proposed settlement exceeds the insurer’s liability limit. Review consent, cooperation and excess-exposure language in the actual form.[^2]

### Price board-defense coverage separately

A policy may include professional-discipline hearing defense, but the cost must be itemized and reported; the coverage may instead be offered and priced separately. Check the declarations and invoice before comparing quotes.[^2]

### Treat notice as a practice workflow

If a Maryland physician practices without insurance, build the required notice into first visits, informed consent and office posting. The statutory notice does not establish that any later claim is covered.[^1]

## Who Regulates Insurance in Maryland

**Maryland Insurance Administration.** The Maryland Insurance Administration licenses producers and insurers, reviews rates and forms, and investigates complaints about insurance companies and producers. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premiums less returned premiums when Maryland is the insured's home state; excludes risks of Maryland and its political subdivisions When Maryland is the insured's home state, the tax is 3% of gross premiums less returned premiums, except insurance of risks of the State or a political subdivision. For policies effective on or after July 21, 2011, Maryland taxes the entire premium and the broker must charge the tax in addition to premium. Maryland's property and casualty guaranty corporation excludes surplus-lines policies.[^6][^7]
