# Maine Medical Malpractice Insurance Guide

Maine’s Rural Medical Access Program assessment is collected separately from professional-liability policies for physicians and hospitals and is not treated as premium for most tax and rate purposes, though it counts as premium for cancellation and nonrenewal. In a professional-negligence judgment with at least $250,000 in future damages, either party may request periodic payments, subject to the court’s finding that the judgment debtor has adequate financial resources or security. ## What to Watch for in Maine

### Separate Maine’s assessment from the quoted premium

For physician and hospital professional-liability policies issued on or after July 1, 1990, insurers collect an assessment from each policyholder; self-insureds pay as directed. The superintendent sets the amount. It is not premium for most tax or rate laws, but it counts as premium for cancellation and nonrenewal. Ask the carrier or employer to identify the assessment and payer separately on the annual cost breakdown.[^1]

### Check which employer or entity bears the assessment

The statute expressly includes physician employers located in Maine and directs state agencies to identify the insuring entity and who makes each physician’s insurance payment. In a group or hospital arrangement, ask whether the employer, clinician or entity is the policyholder and how the assessment appears in the renewal budget; do not assume the clinician pays it directly.[^1]

### A large future-damage award may be paid over time

At either party’s request, Maine courts must order whole or partial periodic payment when future damages reach $250,000, but the court must be satisfied the judgment debtor has adequate financial resources or may require security. This is a payment method, not a malpractice limit or a promise about an insurer’s solvency. Compare policy limits and confirm the insured entity and applicable policy terms separately.[^2]

## Who Regulates Insurance in Maine

**Maine Bureau of Insurance.** The Maine Bureau of Insurance licenses producers and companies, enforces Maine insurance laws, and investigates property and casualty complaints including commercial coverage complaints. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross direct premium when Maine is the insured's home state Maine charges 3% of gross direct premium when it is the insured's home state; your broker handles the tax and may include it with the premium. Surplus-lines policies are outside Maine guaranty-association protection. Maine generally requires a diligent search, with an exempt-commercial-purchaser exception requiring broker disclosure and the purchaser's written request.[^6][^7][^8]
