# Louisiana Medical Malpractice Insurance Guide

A Louisiana provider qualifies for the Medical Malpractice Act by filing proof of financial responsibility and paying the surcharge. A qualified insured provider’s required proof is at least $100,000 per claim, and total recovery for a patient’s injury or death is capped at $500,000 plus interest and costs, excluding future medical care and related benefits. A professional entity can be concurrently qualified without another surcharge only while every eligible person providing care for it is qualified—and it can lose that status if it fails to provide proof when requested.[^1][^2]

## What to Watch for in Louisiana

### The statutory layer depends on completed qualification

The Act requires proof of financial responsibility and payment of a surcharge; for insured providers the minimum is $100,000 per claim. The statute describes qualification taking effect when the insurer accepts the surcharge. Confirm effective date and Fund enrollment for each provider before assuming the PCF layer applies to a claim.[^1]

### Concurrent entity qualification depends on every eligible treating person

A corporation, partnership or LLC may be deemed concurrently qualified without an additional surcharge while each eligible shareholder, member, agent, officer or employee providing care on its behalf is qualified. The entity is not concurrently qualified if it fails to provide proof of financial responsibility after the specified claim-review request or lawsuit. Keep the roster current and respond to Fund proof requests.[^2]

### Separate insured limits, Fund recovery and future-care awards

For qualified providers, the provider’s liability is generally limited to $100,000 per patient and the total recovery under §1231.2(B) is $500,000 plus interest and costs, but future medical care and related benefits are expressly excluded from that overall cap and handled under §1231.3. These statutes do not establish that a policy covers every loss or entity; compare actual policy limits and confirm the statutory qualification.[^1][^2]

## Who Regulates Insurance in Louisiana

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4.85% of gross premium plus a 0.175% SLIP+ transaction fee for policies effective on or after July 1, 2026 For Louisiana-home-state policies effective on or after July 1, 2026, the state charges 4.85% of gross premium plus a 0.175% SLIP+ transaction fee, which your broker may add to your bill. Louisiana's required policy disclosure says these policies are not covered by the Louisiana Insurance Guaranty Association; state placement and filing rules still apply.[^6][^7]

## Medical Malpractice in Louisiana: FAQ

### What does Louisiana’s $500,000 figure cap?

For claims under this Part it caps the total recovery for a patient’s injury or death, plus interest and costs, but excludes future medical care and related benefits. It is not the per-claim limit of an insurance contract.[^1]

### Does a Louisiana practice entity need its own surcharge?

The statute says a qualifying entity may be deemed concurrently qualified without an additional surcharge while every eligible person providing care on its behalf is qualified. The entity must still provide proof when requested in the circumstances specified by §1231.6.[^2]
