# Kentucky Medical Malpractice Insurance Guide

Kentucky requires insurers writing defined medical professional liability insurance to offer it to qualifying charitable providers and their volunteers at limits offered to other insureds; the statutory definition is limited to hands-on services provided directly to patients. The Commonwealth pays the premium only after a written application within one year after the policy expires, and services already insured elsewhere are excluded. Confirm the licensed service scope, funding tests and Cabinet registration before relying on reimbursement.[^1][^2][^3]

## What to Watch for in Kentucky

### The state program is limited to uncovered charitable services

KRS 216.940 makes eligibility service-specific: care must fall within the provider’s licensed or certified scope, carry no charge or expected compensation, and receive no government or insurer payment or reimbursement. KRS 304.40-075(1)(c) separately limits covered insurance to liability from hands-on services provided directly to patients in treatment, diagnosis, or prevention; subsection (4) also excludes charitable services already insured elsewhere. Match both the provider/service and policy to these conditions before requesting premium payment.[^1][^2]

### Build the premium request around the expiring policy

The provider must apply in writing to the Department of Insurance no later than one year after the policy expires. The regulation requires the entire policy, declarations identifying insurer/effective date/policy number/premium, itemized billing and proof of payment, provider license details and the Cabinet registration. Keep these records with the policy-year file; a quote alone is not a reimbursement application.[^2][^3]

### Reimbursement does not remove underwriting duties

Eligible insured providers must follow the insurer’s risk-management and loss-prevention policies. The regulation also requires prompt correction of inaccurate or changed application information and remittance of any premium refund. Ask which volunteers, employees, services and patient volume are scheduled, then keep the covered roster aligned with the filed reimbursement evidence.[^2][^3]

## Who Regulates Insurance in Kentucky

**Kentucky Department of Insurance.** The Kentucky Department of Insurance licenses agents and insurers, monitors the insurance market, and accepts complaints about insurance companies and agents. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% on Kentucky-home-state premiums and other premium consideration; separate 1.8% surcharge on eligible risks located in Kentucky, subject to statutory exceptions; applicable local-government premium tax may also apply When Kentucky is the insured's home state, the state tax is 3% of premium and other consideration treated as premium; local-government premium taxes may also apply. A separate 1.8% surcharge generally applies to Kentucky risks, but state law exempts multistate nonadmitted risks and specified government and nonprofit premiums. ## Medical Malpractice in Kentucky: FAQ

### Is charitable-provider malpractice coverage automatically paid by Kentucky?
