# Indiana Medical Malpractice Insurance Guide

Indiana’s Patient’s Compensation Fund is tied to formal provider qualification: the Department of Insurance collects surcharges and tracks qualified providers, and only providers that qualify under the Medical Malpractice Act receive its protections. The proposed-complaint process sends notice to named providers and known insurers, and the Department’s public database records participation. Confirm each person and entity’s qualification and the insurer’s proof-of-financial-responsibility filing rather than assuming the policy label completes enrollment.[^1][^2]

## What to Watch for in Indiana

### Fund protection follows qualification, not a policy label

Indiana DOI says only health-care providers qualified under the Medical Malpractice Act are protected by its provisions. Its database records provider names, specialties and complaint information. Check the exact individual and any entity in the database and retain the qualification certificate or filing confirmation; do not infer fund participation merely because a policy says “medical malpractice.”[^2]

### A qualifying policy needs a separate filing and surcharge step

The Department administers qualification, surcharges and records under the Act. Before renewal or a carrier change, ask who will file proof of financial responsibility, remit the surcharge and confirm the effective date for every clinician and covered facility. Those administrative steps establish fund status; they do not expand the policy’s insureds, limits or exclusions.[^1]

### A proposed complaint can trigger insurer notice before panel review

Indiana’s Department forwards proposed complaints to named providers and each insurer if known; filing also tolls the applicable limitation period through 90 days after the panel opinion is received. Give the carrier prompt notice under the contract and confirm the current filing instructions: since January 22, 2025 the Department no longer serves included discovery with the complaint.[^2]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 2.5% of gross premium when Indiana is the home state Indiana’s surplus-lines premium tax is 2.5% when Indiana is the insured’s home state.
