# Medical malpractice insurance in the District of Columbia

The District bars a medical professional liability insurer from taking specified adverse insurance actions solely because a covered health-care practitioner provides reproductive or gender-affirming care that is lawful in the District, even if the patient lives where that care is illegal. The rule preserves action for professional misconduct. The Board also requires physicians to report judgments and certain insurer- or employer-paid settlements within 60 days. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** Generally 2% of gross premium, including qualifying placement fees When the District is the insured’s home state, surplus-lines agents and brokers generally owe a 2% tax on gross premium, including necessary fees incidental to placement when separately itemized. An agent or broker procuring insurance on behalf of the District government is exempt for that government business; claiming the exemption requires identifying its allocation in the required affidavit and does not waive other statutory duties.
