# Medical malpractice insurance in Connecticut

Connecticut requires a person licensed to practice medicine and surgery who provides direct patient care to maintain professional liability insurance or other indemnity, generally at least $500,000 per person per occurrence and $1.5 million aggregate. A narrow free-care clinic arrangement can satisfy the individual rule if the clinic meets specified coverage and service conditions. ### The individual duty follows direct patient care

The mandate applies to each person licensed to practice medicine and surgery who provides direct patient care. The free-clinic deeming rule is limited to uncompensated services at a qualifying tax-exempt DPH-licensed clinic meeting staffing and coverage conditions; outside that clinic the physician is subject to the individual rule.[^1]

### Claims-made transitions need an ERP decision

A claims-made policy must give the insured a contractual right to buy equivalent coverage for claims from an insured period, no later than 30 days after policy termination. Confirm the election window, premium, terms, and how prior acts will be handled before cancellation.[^2]

### Free unlimited ERP has narrow triggers

No-additional-charge unlimited extended reporting applies to specified physician, hospital, APRN, or PA claims-made policies only when the insurer voluntarily withdraws from Connecticut and the insured is age 60+ or has five consecutive years with that insurer. It is not a universal free tail.[^2]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4% of gross premium when Connecticut is the home state When Connecticut is the insured’s home state, surplus-lines tax is 4% of gross premium; certain state and local government insureds are exempt, and broker or policy fees are not part of the premium-tax base. Connecticut’s required notice says these policies are outside the state guaranty association.
