# Medical malpractice insurance in Colorado

Colorado requires physicians and physician assistants to establish financial responsibility as a condition of active practice, generally through at least $1 million per incident and $3 million annual aggregate commercial liability coverage. Public employees and board-approved classes may be exempt or subject to lower standards; approved bond, deposit, or self-insurance options exist. Two or more reportable claims in 12 months can double the physician or PA minimum. Institutions follow a distinct $500,000 per incident / $3 million aggregate rule and alternatives.[^1][^2]

## What Is Medical Malpractice?

Medical malpractice insurance can pay defense costs and covered damages when a patient claims a clinician’s care caused harm. If you provide health care, match the quote to your practice, clinicians, specialties and procedures, then check who is insured. [Read the national Medical malpractice guide](/coverage/medical-malpractice).

## Colorado Requirements

| Requirement | Details |
| --- | --- |
| Physicians and physician assistants | Generally $1 million per incident and $3 million annual aggregate, subject to public-employee and Medical Board exemption or reduction rules and alternative approved forms of financial responsibility.[^1] |
| Health-care institutions | Generally $500,000 per incident and $3 million annual aggregate if using commercial coverage; an institution may establish approved alternative financial responsibility. Exclusions and public-entity exceptions apply.[^1] |

## What to Watch for in Colorado

### The mandate has defined license scope

The statute names physicians, PAs, dentists, dental therapists, dental hygienists, and health-care institutions, with a specific exception for facilities under § 13-64-303.5. It does not impose one identical insurance requirement on every health-care worker or business.[^1]

### Claim reporting can change the minimum

For a physician or PA, two or more reports under § 13-64-303 in a 12-month period double the minimum financial-responsibility amount, unless the Board reduces it after a supported motion. Track claim reports and licensing evidence.[^1]

### Institution alternatives need approval evidence

An institution using a self-insured retention, deductible, or limits above its retention must document an approved alternative form of financial responsibility. Verify the institution’s proof and do not treat an individual clinician’s policy as automatically satisfying it.[^1][^2]

## Who Regulates Insurance in Colorado

**Colorado Division of Insurance.** The Division administers Colorado insurance laws and regulates insurers and insurance producers. You can search producer licenses through Colorado’s official DORA lookup and send insurance complaints to the Division.[^3][^4][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of net premium When Colorado is the insured’s home state, its surplus-lines tax is 3% of taxable premium. The Colorado Surplus Lines Association says insurer or broker fees charged in connection with the placement are included in the tax base; federal or other-state taxes and examination fees are excluded. For multistate risks, a tax-sharing agreement may allocate premium tax to other states.[^6][^8][^7]

## Providers With Documented State Licenses

These providers publish a national listing for Medical malpractice; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in Colorado; [check the regulator’s license lookup](https://apps2.colorado.gov/dora/licensing/default.aspx) and confirm state availability for your business when requesting a quote.

- [Corgi](/insurance-providers/corgi) — **Entity:** Corgi Insurance Services, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** Corgi’s company producer-license table lists 50 jurisdictions: 49 states and the District of Columbia, including DC license 3003091619. New Mexico does not appear in the table and is not included here; the omission does not establish that Corgi is unlicensed there. The company-reported table has no stated as-of date and does not establish product availability.[^11]
- [Vouch](/insurance-providers/vouch) — **Entity:** Vouch Specialty Insurance Services, LLC; **role:** Insurance producer, Surplus-lines broker; **checked:** 2026-09-28. **Scope:** Vouch’s licenses page, effective January 16, 2025, lists producer licenses in all 50 states and DC. Its separate surplus-lines table includes Idaho number 870820, while a footnote says Georgia and Idaho do not issue agency-level surplus-lines licenses. Because those statements conflict for Idaho, this record keeps Idaho producer-only and does not treat the table number as established agency surplus-lines authority. The page is company-reported and does not establish product availability.[^16]

## Questions to Ask Before You Buy in Colorado

1. Does the statute apply to each clinician’s credential and the facility’s license, and does any board exemption fit the exact work pattern?
2. If the institution self-insures or has a retention, where is the regulator-approved evidence of alternative financial responsibility?
3. Do recent reportable claims change the required physician or PA minimum, and are defense costs inside the purchased limit?

## Medical Malpractice in Colorado: FAQ

### What is Colorado’s minimum for a physician or PA?

Generally, the statute sets $1 million per incident and $3 million annual aggregate for commercial professional liability coverage. It includes public-employee treatment and allows Board exemptions or lower standards for specified classes and other reasons; verify the exact license and status.[^1]

### Can a Colorado practice satisfy the rule without a conventional policy?

Yes, the statute permits alternatives such as a surety bond, cash or cash-equivalent deposit, and other security accepted by the Insurance Commissioner, including approved self-insurance. An institution with a retention or deductible also has to furnish evidence of approved alternative responsibility.[^1]
