## What to Watch for in Mississippi

### A one-year limit applies to listed libel claims

Mississippi Code § 15-1-35 lists libel among actions to commence within one year after accrual. Preserve each publication date and any later separate publication; the statute does not specify a media-policy reporting deadline.[^1]

### The pre-suit notice rule names particular outlets

Section 95-1-5 applies to libel published by a newspaper domiciled and published in Mississippi or authorized to do business there, and to actions against a radio or television station domiciled in the state. At least ten days before suit, written notice at the defendant’s regular business place must identify the article, broadcast, or telecast and the specific statements alleged false and defamatory.[^2]

### The correction provision has express exceptions

For qualifying claims, a full and fair correction, apology, and retraction within ten days can limit recovery to actual damages only if the publication was in good faith, the falsehood came from an honest factual mistake, and reasonable grounds supported the statement. The statute excludes certain election-window candidate publications, editorials, and regularly published opinion columns.[^2]

### Surplus-Lines Tax and Stamping Office
