# Media liability in Kentucky

Kentucky sets a one-year filing period for libel or slander. For a damages action over a defamatory statement in a newspaper, magazine, or periodical, a separate statute addresses actual damages, mitigation through correction, and when punitive damages may be recovered. Its correction demand must be written, signed, fact-specific, and delivered before suit; the deadline for a timely correction depends on the publication cycle. ### Correction rules cover listed periodicals

KRS 411.051 expressly applies to a defamatory statement in a newspaper, magazine, or periodical. Do not assume its wording automatically governs every online-only, broadcast, or other media format; ask counsel how the particular outlet qualifies.[^2]

### A sufficient demand must arrive before suit

The demand must be in writing and signed by the plaintiff or an authorized attorney or agent. It must identify the claimed false and defamatory statements, explain how they are false, set out the facts, and be delivered before the action begins.[^2]

### Correction timing follows the publishing schedule

A daily newspaper has 10 business days after receiving a sufficient demand to publish a timely correction. For a newspaper, magazine, or periodical that is not daily, the measure is the next regular issue published not less than 10 business days after receipt. Track the actual receipt date and scheduled issue.[^2]

### Punitive damages have additional statutory conditions

The statute permits punitive damages only when the plaintiff alleges and proves publication with legal malice and the periodical failed to make a conspicuous and timely correction after a sufficient demand. A correction may be pleaded in mitigation; neither outcome answers whether an insurance contract responds.[^2]
