# Media Liability Coverage in California

For libel in qualifying daily or weekly news publications and slander by radio, California Civil Code §48a makes a correction demand and response part of the damages analysis; it does not impose a general duty to correct. A plaintiff seeking damages beyond special damages must serve a written demand identifying the statements at the publisher’s place of publication or broadcaster’s place of broadcast within 20 days after learning of them; if the demand is not followed by a qualifying correction within three weeks after service, the plaintiff may recover general, special, and exemplary damages only if the statutory elements are proved and the claim is maintained. A substantially as conspicuous same-outlet correction before demand has the same effect, and exemplary damages require proof of actual malice and remain discretionary; a separate anti-SLAPP procedure may apply to some public-issue claims.[^1][^2]

## What to Watch for in California

### Do not assume the correction rule covers every channel

Section 48a addresses libel in daily or weekly news publications and slander by radio broadcast. A “daily or weekly news publication” may be print or electronic, but it must contain news on matters of public concern and publish at least once a week. Ask counsel whether each format you use fits those definitions; the correction rule does not establish insurance coverage.[^1]

### Escalate a correction demand as soon as it arrives

Section 48a does not generally compel a correction; it sets a damages condition for qualifying libel in a daily or weekly news publication and slander by radio. A plaintiff must serve a written demand identifying the statements on the publisher at the place of publication, or broadcaster at the place of broadcast, within 20 days after learning of them. If the demand is not followed within three weeks after service by a substantially as conspicuous correction in a regular issue of the same publication or on the same station, the plaintiff may recover general, special, and exemplary damages only if the plaintiff proves notice, demand, and failure to correct and maintains the claim. Exemplary damages additionally require proof of actual malice, cannot be inferred or presumed from the publication or broadcast, and remain for the court or jury to decide. A qualifying same-outlet correction before demand has the same effect; route demands promptly to counsel and follow the policy’s separate insurer-notice terms.[^1]

### Ask how defense costs work in a public-issue suit

California permits a special motion to strike certain claims arising from protected speech or petition activity on a public issue and generally awards fees to a prevailing defendant. This is a court procedure, not a promise that a defamation claim will be dismissed or that your insurer will fund the motion; confirm defense-cost limits and consent rules in the policy.[^2]

## Who Regulates Insurance in California

**California Department of Insurance.** The California Department of Insurance regulates insurers and insurance producers, provides company and license-status searches, and accepts complaints through its Consumer Complaint Center. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of taxable premium when California is the insured's home state When California is your home state, the surplus-line broker tax is generally 3% of gross premiums less returned premiums. Ask the broker to show the home-state determination, taxable premium and any applicable exception; ordinary multistate reporting does not itself reduce the tax base. A broker generally must search the admitted market unless a California exemption or the qualified federal commercial-purchaser exception applies. **California usually requires an admitted-market search:** Before most nonadmitted placements, a broker must search among admitted insurers. After a public hearing and the required statutory findings, California’s Commissioner may exempt qualifying coverage or risks through an Export List order. The confidential written report remains required under §1763.1. Separately, §1763(h) waives the search for a commercial insured meeting California’s §1760.1(b) definition: the broker must first give written disclosure about possible admitted-market availability and its potential greater protection and oversight, then receive the insured’s written request for nonadmitted placement. The broker must ensure eligibility, with a safe harbor for reasonable reliance on information supplied in good faith. The federal exempt-commercial-purchaser route under §8205 has its own §8206 definition and requires disclosure about possible admitted-market availability and its potential greater protection and oversight, followed by the purchaser’s written request. **Separate tax calculation from allocation reporting:** Section 1775.5 generally counts the entire premium for nonadmitted insurance placed in one transaction with one underwriter or group for a California-home-state insured. It has a separate interstate-motor-transit formula and exclusions for premiums on insurance placed by or through a special-lines surplus line broker under §1760.5 and the defined risk-financing portion of specified Superfund remediation products. CDI’s calendar-year 2025 instructions include policy-related fees in gross premium, say it does not collect the tax on risks outside the United States, and treat multistate allocation percentages as informational. No. Section 48a covers libel in daily or weekly news publications and slander by radio broadcast. A qualifying publication may be print or electronic, but must contain news on matters of public concern and publish at least once a week. Have counsel classify your actual formats.[^1]

### Does the anti-SLAPP statute guarantee the insurer will pay attorney fees?

No. The statute addresses when a court may award fees after a qualifying motion. Whether the policy pays those costs, and how they affect limits or consent, depends on the policy wording.[^2]

### Does California require a publisher to issue a correction?

No. Section 48a does not create a general duty to correct; it makes an unmet timely demand a condition in the damages framework for specified libel and radio-slander claims.
