# Oregon Management Liability Insurance

Oregon’s current statute sets a five-year BOLI complaint period for specified claims, including discrimination under ORS 659A.030, .082, .112, and .370; other unlawful-practice complaints generally have a one-year deadline. ### An intake questionnaire is not a filed complaint

BOLI says its questionnaire is the first step; the formal complaint must be written, reviewed, signed, and received by BOLI before it is filed. For a buyer, this affects how an early inquiry or charge should be routed and reported under policy terms. Ask how the EPL form handles this allegation type, including wage-and-hour exclusions, defense sublimits, and notice triggers.[^4]

### Private Company Indemnification

Oregon puts business-corporation indemnification in Chapter 60 and nonprofit-corporation rules in Chapter 65. If a named insured is a nonprofit, review its Chapter 65 indemnification provisions and governing documents separately before mapping company obligations to the policy. As a private company, compare your bylaws and indemnity agreement with the policy’s advancement language; Oregon corporate statute does not itself promise insurance payment.[^1][^2]

### Public Employers Have Additional Claim Conditions

ORS 659A.875 requires notice under the Oregon Tort Claims Act in civil actions against a public body and sets distinct limitation rules. Ask who will log the first written notice and confirm the policy reporting date.[^3]
