Louisiana’s Employment Discrimination Law in Chapter 3-A generally covers employers with 20 or more employees in Louisiana on each working day in 20 or more calendar weeks in the current or preceding year, subject to listed exclusions. ## What Is Management Liability?

## What to Watch for in Louisiana

### The state chapter identifies specific protected grounds

Section 23:332 lists race, color, religion, sex, national origin, military status, and natural, protective, or cultural hairstyle among prohibited bases. Ask how the EPL form handles this allegation type, including wage-and-hour exclusions, defense sublimits, and notice triggers.[^1]

### Private Company Indemnification

R.S. 12:1-832 makes the monetary-liability protection subject to any limit or rejection in the articles. Review the filed articles and amendments, then ask whether the policy treats claims outside the statute’s corporation-and-shareholder scope differently. As a private company, compare your bylaws and indemnity agreement with the policy’s advancement language; § 12 does not itself promise insurance payment.[^1]

### Written Notice Precedes A Chapter 3-A Civil Action

Section 23:303 requires a written notice at least 30 days before suit, including specified facts and an effort to resolve in good faith. This procedure is separate from any policy notice obligation. Ask who will log the first written notice and confirm the policy reporting date.[^4]

## Who Regulates Insurance in Louisiana
