# Alaska management-liability coverage when workers raise safety concerns

AKOSH identifies workplace safety complaints, injury reports, and participation in enforcement as protected activity under Alaska law. The state guidance also narrows the issue to worksite conditions and preserves discipline for reasons unrelated to protected activity. For a plan subject to ERISA § 412, check the plan’s bond against the statute’s scope and exceptions; the law does not establish what a management-liability policy covers.[^1][^2][^3]

## What to Watch for in Alaska

### Match EPL planning to the worksite-reporting channel

A crew member who reports an injury or raises a workplace safety concern may trigger an AKOSH inquiry if later disciplined. Train supervisors to document an independent reason for an action and preserve reporting records; ask whether the EPL quote addresses defense of retaliation allegations and whether notice rules require early reporting.[^1]

### Do not treat every public-safety complaint as this AKOSH claim

The Alaska regulation distinguishes a complaint about conditions at work from a complaint only about general public safety. The refusal-to-work protection is also narrow and fact-dependent. These limits define the legal exposure to discuss; they do not determine how a policy responds to a particular allegation.[^1][^2]

### Separate plan misconduct, plan loss, and workplace allegations

ERISA § 412 requires a plan-protective bond for covered fiduciaries and people who handle plan funds or property, subject to statutory and regulatory exceptions. The bond addresses plan loss from fraud or dishonesty; the regulation ties “handling” to risk-creating access or authority. Give the broker the plan, roles with access to assets, and existing bond so you can compare covered people and limits with the applicable rule. This does not establish what a management-liability policy covers.[^3][^4]

## Who Regulates Insurance in Alaska

**Alaska Division of Insurance.** The Alaska Division of Insurance regulates insurers and insurance licensees, provides company and licensee searches, and investigates insurance complaints within its authority. Its consumer-services section handles disputes involving claims, cancellations, premium refunds, agents, and insurers.[^5][^6][^7]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 2.7% of gross premium less returns plus 1% filing fee; wet marine: 0.75%, no fee For covered property and casualty surplus-lines risks, Alaska lists a 2.7% tax and a separate 1% filing fee on gross premium less returned premium. Qualifying wet-marine and transportation policies instead carry a 0.75% tax on gross premium and no filing fee; risks of state or local government and certain interstate aircraft are exempt from both tax and fee. A multistate placement is regulated under the insured’s home-state rules, and Alaska says to evaluate each policy’s home state separately.[^9][^8][^10][^11]

**Alaska has a placement-list exception:** If a risk appears on Alaska’s surplus-lines placement list, the Division says the broker does not have to canvass admitted insurers for declinations before placement; the broker must document the applicable list entry.[^8]

**Alaska has limited tax and search exceptions:** The Division says qualifying wet-marine and transportation policies need no diligent search and pay no 1% filing fee. Tax and filing fees also do not apply to state or political-subdivision risks or qualifying interstate aircraft, although other placement requirements remain.[^12]

### What Alaska timing point should an employer remember for an AKOSH retaliation complaint?

The state labor department says a complaint must be filed within 30 days of the unfavorable personnel action. That is a deadline in the agency process, not a policy-notice deadline; check the policy’s own reporting terms.[^1]

### Does an unsafe-work report automatically protect a worker who leaves the job?

No. Alaska’s guidance describes a narrow refusal-to-work rule tied to serious, urgent worksite danger, employer notice where feasible, and the lack of time for regular enforcement. Have employment counsel assess the facts; do not infer policy coverage from the rule.[^1][^2]
