# Liquor Liability in Pennsylvania

Pennsylvania Liquor Code § 497 limits licensee liability to third parties for off-premises damages unless the customer was visibly intoxicated when served. The state’s RAMP program is generally voluntary, but certification can be required after certain citations or for particular permits and agreements.[^1][^2]

**Coverage:** [Liquor liability](/coverage/liquor-liability) · [Pennsylvania](/coverage/states/pennsylvania)

## What Is Liquor Liability?

Liquor liability can cover claims tied to your business selling, serving or furnishing alcohol. If you run a bar, restaurant or event where you provide drinks, check how the quote treats injuries, property damage and occasional service. [Read the national Liquor liability guide](/coverage/liquor-liability).

## What to Watch for in Pennsylvania

### Visible Intoxication Is the Statutory Trigger

Section 497 addresses third-party off-premises damages and requires that the customer have been visibly intoxicated when the licensee or its worker furnished alcohol. Ask the broker to explain the covered claim scenarios and how defense expenses affect limits.[^1]

### RAMP Can Become a License Condition

Pennsylvania describes RAMP as voluntary generally, but certification can be required for specified administrative citations, conditional license agreements, and certain permits. Ask whether any current citation or permit makes your business subject to a RAMP requirement and keep certification records.[^2]

### State Guidance Focuses on Observable Signs

PLCB says staff are not expected to determine a patron’s blood alcohol concentration; they should use observable behavior and appearance and stop service when visible intoxication is apparent. Ask whether your written service and incident procedures match this standard.[^3]

## Who Regulates Insurance in Pennsylvania

**Pennsylvania Insurance Department.** The Pennsylvania Insurance Department publishes state tools to check licensed producers, agencies, and insurers, and its Consumer Services Online portal accepts complaints about insurers, agents, brokers, and public adjusters. The department also oversees Pennsylvania insurance business and consumer services.[^4][^5][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premium (2% for eligible surplus-lines risk retention groups) Pennsylvania charges 3% of gross surplus-lines premiums (2% for an eligible surplus-lines risk-retention group); the tax is in addition to premium, is borne by the insured, and is collected by the producer. For multistate risks, the 2025 Revenue instructions say all gross premiums are taxable when Pennsylvania is the home state, while Insurance Company Law §1621(d) says tax is levied only on premium reasonably ascribable to Pennsylvania risk; confirm allocation with your producer or the state. Surplus-lines coverage is excluded from the guaranty association, and qualifying large risks or exempt commercial purchasers may use distinct no-search routes, with the ECP route requiring disclosure and written request.[^7][^8][^9][^10]

## Providers With Documented State Licenses

These providers publish a national listing for Liquor liability; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in Pennsylvania; [check the regulator’s license lookup](https://www.pa.gov/agencies/insurance/resources/search-tool-library) and confirm state availability for your business when requesting a quote.

- [Corgi](/insurance-providers/corgi) — **Entity:** Corgi Insurance Services, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** Corgi’s company producer-license table lists 50 jurisdictions: 49 states and the District of Columbia, including DC license 3003091619. New Mexico does not appear in the table and is not included here; the omission does not establish that Corgi is unlicensed there. The company-reported table has no stated as-of date and does not establish product availability.[^13]

## Questions to Ask Before You Buy in Pennsylvania

1. Does our policy cover off-premises injury claims alleging visible intoxication under § 497?
2. Does a citation, conditional license agreement, or permit require RAMP certification at our premises?
3. How do we preserve staff observations and incident records after service is refused?

## Liquor Liability in Pennsylvania: FAQ

### Is RAMP certification mandatory for every Pennsylvania bar?

No. PLCB describes RAMP as generally voluntary, though certification may be required for specified citations, conditional license agreements, or permits.[^2]
