# New Jersey Liquor Liability: Visible Service, Minor Claims, and Host Rules

For a licensed New Jersey alcohol server, a claimant must show service to a visibly intoxicated person or service to a minor when the server knew or reasonably should have known the person was a minor, plus proximate cause and foreseeability. An adult social-host claim has a different test: willful and knowing provision to a visibly intoxicated adult, foreseeable risk, failure to use reasonable care, and an accident caused by that person’s negligent driving. Permit-specific insurance conditions do not establish a general rule for every license class.[^1][^3]

## New Jersey Requirements

## What to Watch for in New Jersey

### Commercial claims require a defined service event and causation

Under N.J.S.A. 2A:22A-5, the claimant must show service to a visibly intoxicated person or to a minor when the server knew or reasonably should have known the person was a minor, and that the service proximately caused a foreseeable injury or property loss. The official court opinion describes visible intoxication as perceptible acts presenting clear signs and says circumstantial evidence can be relevant; do not reduce the minor standard to actual knowledge alone.[^1][^2]

### The adult social-host rule is limited to a motor-vehicle accident

For an adult social host within §2A:15-5.5, §2A:15-5.6 requires willful and knowing provision to someone visibly intoxicated in the host’s presence or in circumstances showing reckless disregard, an unreasonable foreseeable risk, failure to use reasonable care, and a vehicle accident caused by the guest’s negligent driving. The law sets blood-alcohol presumptions below 0.10% and from 0.10% to under 0.15%; it is not the licensed server test.[^3][^4]

### The civil standard and permit proof do not define policy response

ABC permit instructions show that insurance proof can depend on a specific activity, while the Dram Shop Act defines when a civil claim can proceed. A commercial general-liability form, host-liquor wording, and liquor-liability form may treat selling or serving as part of the business differently. The insurer specimen cited here is a 2024–2025 Texas restaurant example; compare your issued declarations and forms, not the specimen, when checking coverage.[^5][^1][^7]

## Who Regulates Insurance in New Jersey

**New Jersey Department of Banking and Insurance.** New Jersey DOBI licenses insurers and producers, reviews insurance products and rates, monitors insurer solvency and responds to insurance complaints. The Property and Casualty unit regulates commercial and personal property and casualty rates, rules and forms.[^8][^9][^10][^11]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 5% of gross premium, less return premium New Jersey’s Department of Banking and Insurance states a 5% surplus-lines tax for policies effective on or after July 1, 2009; its FAQ also describes direct-procurement tax filing for premium allocated to New Jersey. A New Jersey surplus-lines producer generally must make a diligent effort to place the risk with authorized insurers, subject to the exportable-list and other statutory exceptions. New Jersey’s separate surplus-lines guaranty fund has narrow coverage; ordinary commercial surplus-lines claims are generally outside guaranty protection.[^12][^13][^14]

## Liquor Liability in New Jersey: FAQ

### Can an adult social-host standard be used for a licensed restaurant?

No. The commercial-server standard under N.J.S.A. 2A:22A-5 concerns visible intoxication or service to a minor with actual or constructive knowledge, plus causation and foreseeability. Section 2A:15-5.6 separately limits adult social-host claims to a qualifying motor-vehicle accident and additional elements.[^1][^3]

### Must a New Jersey licensed server actually know a patron is underage?

The commercial statute says the server may be negligent if the server knew or reasonably should have known the person was a minor. Service to a visibly intoxicated person is a separate trigger, and both tracks retain the statute’s causation and foreseeability elements.[^1]
