# Missouri Liquor Liability: By-the-Drink Claims

Missouri’s § 537.053 cause of action is limited to a person licensed to sell liquor by the drink for on-premises consumption. Clear and convincing evidence must show either that the seller knew or should have known liquor was served to someone under 21, or that the seller knowingly served a visibly intoxicated person. The statute separately limits adult claims for injury caused by the adult’s own voluntary intoxication.[^1]

## What to Watch for in Missouri

### A package license is not the statute’s named seller class

Section 537.053(2) names a seller licensed to sell intoxicating liquor by the drink for consumption on the premises. Missouri’s insurance regulator likewise defines reported dram-shop coverage around on-premises by-the-drink vendors and excludes package-liquor and grocery-store risks from that reporting category. This distinction concerns statutory and reporting scope; it does not prove what a policy covers.[^1][^2][^3]

### The proof standard and service triggers are specific

A claimant must prove a listed service circumstance by clear and convincing evidence against a person licensed to sell by the drink for on-premises consumption. For an underage sale, the seller must have known or should have known liquor was served to a person under 21; the separate visible-intoxication trigger requires knowing service to a visibly intoxicated person. Missouri defines visible intoxication by significantly uncoordinated physical action or significant physical dysfunction; blood-alcohol content may be relevant but is not prima facie proof. For an underage claim, apparently genuine identification demanded and shown may affect the seller’s relative fault; it is not an automatic defense. Ask how the quoted form treats the alleged conduct and defense costs.[^1][^5]

### The injured drinker’s own voluntary intoxication changes who can claim

The statute denies a claim to an adult or the adult’s dependents, representative, or heirs for injury or death proximately caused by that adult’s voluntary intoxication; it preserves a stated exception for a person under 21. A separate claim by someone harmed by the drinker still must fit the statute and prove its elements.[^1]

### List each operating class and location

Missouri ATC lists separate package and by-the-drink license types, plus special resort, caterer, boat, and other permits. Send the actual classes, locations, food and alcohol sales, and event operations to the broker; a policy specimen’s separate liquor form and endorsements do not show what has been added to your quote.[^3][^5]

### Do not read a premium-reporting rule as a coverage mandate

Missouri’s insurance department tells insurers how to classify and report dram-shop premiums and losses. That reporting rule distinguishes on-premises drink sellers from package and grocery retailers; it does not require a licensee to buy a particular policy or establish that any particular risk is insurable.[^2][^4]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 5% of premium; Missouri taxes the entire gross premium when Missouri is the home state When Missouri is the insured’s home state, the state applies its 5% surplus-lines tax to the entire gross premium of a multistate policy; the regulator’s FAQ says the tax includes applicable fees. 3. Do the quoted limits include defense costs, and are there premises, assault-and-battery, or other alcohol-related sublimits or exclusions?
4. Who may be an insured under the form: the license holder, related LLC, employees, caterer, venue, or landlord?

## Liquor Liability in Missouri: FAQ

### Does commercial general liability automatically cover a Missouri bar’s alcohol claims?

Do not assume that it does. An insurer specimen reviewed here includes a separate liquor-liability form and endorsements; your declarations and attached forms determine the coverage actually issued.[^5]

### Does § 537.053 apply to a social host or package-only seller?

Its private cause of action names a person licensed to sell by the drink for on-premises consumption. That wording should not be generalized to social hosts or sellers operating only under a package license.[^1][^3]
