# Massachusetts liquor liability: negligent service, license requirements, and event rules

Massachusetts Chapter 138, §12 on-premises license applicants and holders must provide proof of liquor legal liability insurance, at least $250,000 per injured person and $500,000 per accident involving multiple people. A separate negligent-service claim still depends on proof about service to a visibly intoxicated patron and causation; a license violation is not automatic proof that a policy covers the claim. Caterer licenses have their own event and proof rules.[^8][^1][^2]

## What Is Liquor Liability?

Liquor liability can cover claims tied to your business selling, serving or furnishing alcohol. ## Massachusetts Requirements

## What to Watch for in Massachusetts

### Service-time evidence matters

Chapter 138, §69 bars a licensed premises from selling or delivering alcohol to an intoxicated person. In a commercial negligent-service claim, the Supreme Judicial Court requires evidence the patron was visibly intoxicated when served; later intoxication alone does not show what the server could see at the last service. Preserve incident reports, service records, witness details, and available video under a consistent retention process.[^1][^2]

### Caterers have a separate license and event checklist

A chapter 138, §12C caterer must carry liquor liability limits of at least $250,000 per person and $500,000 per accident for multiple injured people, may serve for no more than five hours at an event, and must send the local licensing authority proof of insurance with event notice at least 48 hours before service. Confirm the event town permits that license and that the insured operations include off-site service.[^3]

### Repeat service violations can change license limits

If a licensing authority finds a §12 licensee served someone under 21 or intoxicated in violation of the law within the prior 24 months, it may require insurance as a condition of license modification, reinstatement, or renewal and may require at least $100,000 for one person and $200,000 for all people, or increase the §12 limits where those already apply. This is a discretionary licensing sanction in addition to the standard §12 proof requirement; ask the authority for any order affecting your license.[^4][^8]

### Commercial service and social hosting are different exposures

The Supreme Judicial Court recognized a limited common-law claim against an adult social host who knew or should have known a guest was drunk, nevertheless furnished or permitted another drink, and could reasonably foresee the guest driving and injuring someone. That is not the same setting or legal test as negligent service by a licensed business. Ask whether your policies cover private functions, staff-hosted events, and alcohol served as part of your business.[^7][^5]

## Who Regulates Insurance in Massachusetts

**Massachusetts Division of Insurance.** The Massachusetts Division of Insurance licenses insurers and producers, reviews rates and forms, and handles insurance complaints. Use the State Based Systems lookup for producers, agencies, and surplus-lines brokers. For insurer status, use the DOI’s separate licensed or approved company lists, including the eligible surplus-lines company list. Before filing a complaint, contact the insurer or producer; if the response is unsatisfactory, submit the online form with supporting papers. The DOI says not to use the form for ongoing litigation.[^9][^10][^11][^12]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4% of gross premiums less gross return premiums on risks or exposures in Massachusetts or another state when Massachusetts is the insured’s home state. A diligent effort to place coverage with admitted insurers is generally required before surplus-lines placement through a specially licensed Massachusetts broker. The narrow §224 large-commercial exception is described in the note below.[^13][^14][^15][^16]

**Multi-state surplus-lines tax dates and exceptions:** For this rule, home state means the state of the insured’s principal place of business or, for an individual, principal residence; if 100% of the risk is outside that state, home state is where the greatest percentage of taxable premium for that insurance contract is allocated. For multi-state policies effective on or after August 10, 2018, the Division of Insurance says the 4% tax applies to gross premium regardless of whether risks are inside or outside Massachusetts when Massachusetts is the insured’s home state. For earlier effective dates, Massachusetts risk portions are taxed at 4%, while out-of-state portions are taxed at the rates for their allocated premium. The Division lists exceptions for policies issued to the Massachusetts Bay Transportation Authority, federal credit unions when they are the purchaser, and tribal lands on reservations. Brokers still make required filings for exempt policies. Tax-exempt status alone is not specifically excluded.[^13][^14]

**Narrow large-commercial placement exception:** Section 168(b)(iv) exempts the diligent-effort affidavit and excess-placement condition in §168(b)(iii) only for a §224 qualifying commercial risk or policyholder. The policyholder must acknowledge in writing that the insurer is not admitted and that the Massachusetts Insurers Insolvency Fund will not pay an insolvency loss. Section 224 eligibility is limited to a corporation, partnership, trust, sole proprietorship, or other business or public entity with at least $30,000 in aggregate property-and-casualty premiums, excluding workers’ compensation. The holder must certify its election and understanding of limited regulatory oversight and certify at least two criteria: net worth of $10 million; net revenue or sales of $5 million; more than 25 employees per individual company OR more than 50 employees per holding company aggregate; a nonprofit or public entity with annual budget or assets of $25 million or more; a municipality with population of 20,000 or more; or retention of a risk manager who is either a full-time employee or retained by the policyholder; that person must be licensed and hold one of these qualifications: certified insurance counselor, chartered property and casualty underwriter, associate in risk management, certified risk manager, or licensed insurance advisor in property and casualty.[^15][^16]

1. Is the operation licensed under §12 or §12C, and does the quoted policy and certificate cover every service location, including catered events?
2. Show the general-liability alcohol exclusion and any host-liquor language alongside the liquor legal liability form; which policy defends an employee-service, private-hosting, or on-premises injury claim?
3. Do the liquor liability limits apply per person and per accident as required, and has the local licensing authority ordered increased limits or additional certificate terms?

## Liquor Liability in Massachusetts: FAQ

### Does a liquor legal liability label guarantee the same protection as general liability?

No. Massachusetts law describes liquor legal liability insurance as covering the insured’s legal liability for death or injury from negligent alcohol distribution, sale, or service. It does not state what a particular general-liability policy excludes or how a host-liquor endorsement applies. Compare the actual forms and named insureds.[^5]

### Can an intoxicated customer sue the business for the customer's own injury?

For injuries caused by negligent alcohol service, §85T bars the intoxicated person’s claim against a properly licensed business or a business serving alcohol incidentally unless the business acted willfully, wantonly, or recklessly. It does not eliminate claims by other injured people.[^6]
